{"data":{"id":"us-ky/krs-431.079","jurisdiction":"us-ky","citation":"KRS 431.079","heading":"Petition or application seeking expungement to include certification of","body":"eligibility for expungement from Department of Kentucky State Police and\nAdministrative Office of the Courts -- Administrative regulations --\nConstruction.\n(1) Every petiti on or application filed seeking expungement of a conviction shall\ninclude a certification of eligibility for expungement. The Department of Kentucky\nState Police and the Administrative Office of the Courts shall certify that the\nagencies have conducted a criminal background check on the petitioner and whether\nor not the petitioner is eligible to have the requested record expunged. The\nDepartment of Kentucky State Police shall promulgate administrative regulations to\nimplement this section, in consultation w ith the Administrative Office of the\nCourts.\n(2) Nothing in this section shall be construed to prohibit the expungement of a case\nordered by a court of competent jurisdiction.\n(3) For the purposes of this section, KRS 431.073, 431.076, and 431.078,\n\"expungement\" means the removal or deletion of records by the court and other\nagencies which prevents the matter from appearing on official state -performed\nbackground checks.","path":["KRS Chapter 431"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=49360","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:59:45Z","sha256":"4085dfe82a456a46328ad8b4bdc86a376bc468bdc7df3d36d8e9e0aad9671f02","source_id":"us-ky","stale":false,"prev":"us-ky/krs-431.078","next":"us-ky/krs-431.0795"},"notice":"GroundRules: Original legal text.
