{"data":{"id":"us-ky/krs-431.0795","jurisdiction":"us-ky","citation":"KRS 431.0795","heading":"Expungement fund.","body":"(1) There is hereby created in the State Treasury a fund designated the \"expungement\nfund.\"\n(2) The fund shall be administered by the Justice and Public Safety Cabinet.\n(3) Beginning on June 27, 2019, the revenues and interest from the expungement fee\nimposed by KRS 431.073 shall be deposited in the fund.\n(4) On January 1, April 1, July 1, and October 1 of each year, the balance of the fund\nshall be distributed as follows:\n(a) Ten percent (10%) shall be distributed to the Department for Libraries and\nArchives;\n(b) Forty percent (40%) shall be distributed to the Department of Kentucky State\nPolice;\n(c) Forty percent (40%) shall be equally distributed among the offices of\nCommonwealth's attorneys; and\n(d) Ten percent (10%) shall be distributed to the Administrativ e Office of the\nCourts to be deposited into the trust and agency account for deputy circuit\nclerks along with the fee established in KRS 431.073(10).\n(5) All interest earned on moneys in the fund shall be credited to the fund and shall not\nlapse.\n(6) Notwithstanding KRS 45.229, fund amounts not expended at the close of a fiscal\nyear shall not lapse but shall be carried forward into the next fiscal year.\n(7) Moneys deposited in the fund are hereby appropriated for the purposes set forth in\nthis section and s hall not be appropriated or transferred by the General Assembly\nfor any other purposes.","path":["KRS Chapter 431"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=49361","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:59:45Z","sha256":"e925e813f4b505429203be77e1a007014c9d0f0ae1bd4ba049660e73ae57ce9a","source_id":"us-ky","stale":false,"prev":"us-ky/krs-431.079","next":"us-ky/krs-431.080"},"notice":"GroundRules: Original legal text.
