{"data":{"id":"us-ky/krs-431.410","jurisdiction":"us-ky","citation":"KRS 431.410","heading":"When issuance of summons is mandatory.","body":"The issuance of a summons rather than an arrest warrant shall be mandatory for all\noffenses, except for violations of KRS 189.290, 189.393, 189.520, 189.580, 511.080 or\n525.070, which are deemed violations as defined in KRS 532.020(4) and traffic\ninfractions for which a fine only can be imposed unless the judicial officer finds that:\n(1) The defendant previously has failed to respond to a citation or summons for an\noffense; or\n(2) He has no ties to the community and there is a substantial likelihood that he will\nrefuse to respond to a summons; or\n(3) The whereabouts of the defendant are unknown and the issuance of an arrest\nwarrant is necessary in order to subject him to the jurisdiction of the court; or\n(4) Where arrest is necessary to prevent imminent bodily harm to the accused or to\nanother; or\n(5) For any other good and compelling reason as determined by the judicial officer.","path":["KRS Chapter 431"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=18620","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:59:46Z","sha256":"f7382325fe30d4c6c4978240c8f44f6abc6bedbc858e811910cbb91403d60baf","source_id":"us-ky","stale":false,"prev":"us-ky/krs-431.400","next":"us-ky/krs-431.420"},"notice":"GroundRules: Original legal text.
