{"data":{"id":"us-ky/krs-431.518","jurisdiction":"us-ky","citation":"KRS 431.518","heading":"Pretrial release of felony drug offender or felony offender with a history of","body":"substance abuse -- Conditions.\nWhen considering the pretrial release of a person charged with a felony offense under\nKRS Chapter 218A or a person charged with a felony offen se whose criminal record\nindicates a history of recent and relevant substance abuse, the court considering the\nrelease shall cause the court's pretrial release investigation and services office to have the\nperson screened for recent and relevant substance abuse risk factors. A person's refusal to\nparticipate in the screening shall not disqualify the person from being granted pretrial\nrelease. If this screening indicates the presence of recent and relevant substance abuse risk\nfactors, the court may order as a condition of pretrial release that the person:\n(1) Undertake any testing ordered by the court under KRS 431.520 or 431.525;\n(2) Participate in an additional assessment of the person's condition;\n(3) Participate in a secular or faith -based treatment or r ecovery program if one (1) is\nidentified as appropriate to the person as a result of the person's initial assessment\nor an additional assessment performed under subsection (2) of this section;\n(4) Appear at any subsequent hearing ordered by the court where  the person's\nconditions of pretrial release may be reviewed and modified as the result of any\ntesting performed under subsection (1) of this section, any additional assessment\nperformed under subsection (2) of this section, any additional assessment of th e\ndefendant performed by a qualified mental health professional which the defendant\nmay offer for the court's consideration, or the person's compliance with any\ntreatment or recovery plan ordered by the court under subsection (3) of this section;\nand\n(5) Participate in a global positioning monitoring system program operated by a county\npursuant to KRS 67.372 and 67.374 under the same terms and conditions as\nprovided in KRS 431.517, during all or part of the person's period of release\npursuant to this section.","path":["KRS Chapter 431"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=18630","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:59:46Z","sha256":"6b1dd84ec1430091e990a3c17e8f98e6cd95ab56c4f6f4dfcf49d6cab98d68c7","source_id":"us-ky","stale":false,"prev":"us-ky/krs-431.517","next":"us-ky/krs-431.520"},"notice":"GroundRules: Original legal text.
