{"data":{"id":"us-ky/krs-431.532","jurisdiction":"us-ky","citation":"KRS 431.532","heading":"Bail deposits by person other than defendant.","body":"When deposits of money are made by a person other than the defendant utilizing funds\nother than those of the defendant as bail security pursuant to KRS 431.530 the following\nterms and conditions shall apply in lieu of the provisions of subsections (3) and (4) of\nKRS 431.530:\n(1) The deposit shall be listed as being made on behalf of the defendant by the\ndepositor and not in the name of the defendant;\n(2) If the conditions of release have been performed and the defendant  has been\ndischarged from all obligations in the action the clerk of the court shall return to the\nperson who deposited the money ninety percent (90%) of the sum deposited and\nshall retain as bail costs ten percent (10%) of the amount deposited provided,\nhowever, in no event shall the amount retained by the clerk as bail costs be less than\nfive dollars ($5);\n(3) No deductions shall be made by the court for public advocate services, satisfaction\nof fines, payment of attorneys, or any other purpose when the defendant has been\ndischarged as pr ovided in subsection (2) of this section unless agreed to by the\nposter of the bond.\n(4) If the defendant has performed all conditions of release and if the defendant is\nfound not guilty of the offense for which bail was posted, or if all charges against\nhim relating to the offense for which bail was posted are dropped or dismissed, then\nall bail money deposited pursuant to this section shall be returned to the person\nposting the bail with no deductions therefrom as provided in subsection (3) or (4) of\nKRS 431.530.","path":["KRS Chapter 431"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=18637","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:59:46Z","sha256":"5afa25a92e7517e723e8d7e72fbff316197621c12092b6d2f88ea78a64706bfa","source_id":"us-ky","stale":false,"prev":"us-ky/krs-431.531","next":"us-ky/krs-431.535"},"notice":"GroundRules: Original legal text.
