{"data":{"id":"us-ky/krs-433.873","jurisdiction":"us-ky","citation":"KRS 433.873","heading":"Wrongful disturbance or damage to cave surfaces or material found","body":"therein.\n(1) It shall be unlawful for any person, without the express, prior, written permission of\nthe owner, to willfully and knowingly:\n(a) Break, break off, crack, carve upon, write, burn, or otherwise mark upon,\nremove, or in any manner destroy, disturb, deface, mar or harm the surfaces of\nany cave or any material which may be found therein, notwithstanding\nwhether such material is attached or broken, including speleothems,\nspeleogens, and sedimentary deposits. The provisions of this section shall not\nprohibit minimal disturbance for scientific exploration.\n(b) Break, force, tamper with or otherwise disturb a door, lock, gate, or other\nobstruction designed to control or prevent access to any cave, even though\nentrance thereto may not be gained.\n(c) Place any gate or other obstruction which may restrict the movement of air or\nanimals through such device.\n(d) Deface, tamper with or remove a sign stating that a cave is posted or citing\nprovisions of this chapter.\n(e) Excavate, remove, destroy, injure, deface, or in any other manner disturb any\nburial grounds, historic or prehistoric resources, archaeological or\npaleontological site or any part thereof, including fossils, bones, relics,\ninscriptions, saltpeter workings, remains of historical human activity, or any\nother such features which may be found in any cave, except those caves\nowned by the Commonwealth or designated as Commonwealth archaeological\nsites or zones, and which are subject to the provisions of KRS 164.705 to\n164.735.\n(2) The entering or remaining in a  cave which has not been posted by the owner shall\nnot by itself constitute a violation of this section.","path":["KRS Chapter 433"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=18821","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:59:48Z","sha256":"8c50b2bcd864e60b7cd89d60c9fcf0a464ccd45169bbd8dbf2f0dcaf713fa9cc","source_id":"us-ky","stale":false,"prev":"us-ky/krs-433.871","next":"us-ky/krs-433.875"},"notice":"GroundRules: Original legal text.
