{"data":{"id":"us-ky/krs-433.900","jurisdiction":"us-ky","citation":"KRS 433.900","heading":"Definitions for KRS 433.900 to 433.925.","body":"As used in KRS 433.900 to 433.925, unless the context otherwise requires:\n(1) \"Applicant\" means a secondary metals recycler seeking an application for a license\nwith the commission. If the secondary metals recycler is owned by a corporation,\nlimited liability company, partnership, limited partnership, incorporated association,\nor any other entity organized for the purpose of engaging in business as a secondary\nmetals recycler, \"applicant\" means the officers of these entities;\n(2) \"Commission\" means the Motor Vehicle Commission;\n(3) \"Ferrous metals\" means any metal containing significant quantities of iron or steel;\n(4) \"Name-based background check\" means a statewide search of the centralized\ncriminal history record information system by the Department of Ken tucky State\nPolice, utilizing the name, date of birth, and Social Security number of the\napplicant;\n(5) \"Nonferrous metals\" means metal not containing significant quantities of iron,\nincluding but not limited to copper, brass, aluminum, bronze, lead, zinc,  nickel, and\nalloys thereof, such as any copper or bronze wire, power inverters, bars, pipes, rods,\ntubing, and wire or cable or coaxial cable of the type used by public utilities,\ncommon carriers, or telecommunication services providers;\n(6) \"Restricted metals\" means any of the following metal items:\n(a) Manhole covers;\n(b) Electric light poles or other utility poles;\n(c) Guardrails;\n(d) Street signs, traffic signs, or traffic signals;\n(e) Whole road tiles;\n(f) Funeral markers or funeral vases;\n(g) Railroad equipment, including but not limited to a tie plate, signal house,\ncontrol box, switch plate, e-clip, or rail tie junction;\n(h) Condensing or evaporating coils made from copper, aluminum, or aluminum -\ncopper, including the tubing or rods from a heating or air conditioning unit\nthat is not from a window air conditioning unit or automobile air conditioning\nunit;\n(i) Stainless steel beer kegs;\n(j) A catalytic converter or any nonferrous part of a catalytic converte r unless\npurchased as part of a vehicle; or\n(k) Storm drain covers; and\n(7) (a) \"Secondary metals recycler\" means:\n1. Any person who is engaged in the business of gathering or obtaining\nferrous or nonferrous metals that have served their original economic\npurpose or is in the business of performing the manufacturing process\nby which ferrous metals or nonferrous metals are converted into raw\nmaterial products consisting of prepared grades and having an existing\nor potential monetary value;\n2. Any person who has facilities for performing the manufacturing process\nby which ferrous metals or nonferrous metals are converted into raw\nmaterial products consisting of prepared grades and having an existing\nor potential monetary value, other than by the exclusive use of hand\ntools, by methods including but not limited to processing, sorting,\ncutting, classifying, cleaning, baling, wrapping, shredding, shearing, or\nchanging the physical form or chemical content thereof; or\n3. Any recycler, dealer in junk or metals, deal er in secondhand articles,\nvendor of bottles or rags, or collector of or dealer in articles found in\nashes, garbage, or other refuse, whether a dealer, collector, or vendor\noperates an established place of business or an itinerant business.\n(b) \"Secondary metals recycler\" shall not include a municipal solid waste\ndepartment or any entity which has been issued a municipal solid waste\ntransporter license by the Transportation Cabinet and which gathers or obtains\nferrous or nonferrous metals in a vehicle regis tered in Kentucky to transport\nsolid waste.","path":["KRS Chapter 433"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=57047","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:59:48Z","sha256":"87987c09249d8d81732620be41f6d25627d85174b3e0604900d4dbb5faaba9ed","source_id":"us-ky","stale":false,"prev":"us-ky/krs-433.896","next":"us-ky/krs-433.902"},"notice":"GroundRules: Original legal text.
