{"data":{"id":"us-ky/krs-433.904","jurisdiction":"us-ky","citation":"KRS 433.904","heading":"Requirements for purchase of restricted metals by secondary metals","body":"recycler -- Cash transactions prohibited -- Payment to be made by check --\nDaily reports to sheriff and police -- Confidentiality of information -- Proof of\nownership of restricted metals -- Applicability.\n(1) (a) A secondary metals recycler shall not enter into any cash transaction for the\npurchase of any restricted metals as defined in KRS 433.900.\n(b) Payment by a secondary metals recycler for the purchase of restricted metals\nshall be made by check issued to the seller and payable to the seller.\n(c) Each check for payment shall be mailed by the secondary metals recycler\ndirectly to the street address of the seller. Payment shall not be mailed to a\npost office box.\n(d) Each check sh all be mailed by the secondary metals recycler to the seller no\nsooner than one (1) day after the purchase transaction.\n(2) At the close of each business day, a secondary metals recycler shall make a report\ndescribing any purchases of restricted metals as defined in KRS 433.900, in digital\nformat, in writing, or by other electronic means to:\n(a) The sheriff of the county in which the purchase transaction was made by a\nsecondary metals recycler and the sheriff of the county where the secondary\nmetals recycler is located; and\n(b) The police department of the city, county, charter county government, urban -\ncounty government, consolidated local government, or unified local\ngovernment in which the purchase transaction was made and the police\ndepartment of the city , county, charter county government, urban -county\ngovernment, consolidated local government, or unified local government in\nwhich the secondary metals recycler is located.\nThe information required by this subsection shall remain confidential, and this\ninformation shall include the following disclosure: \"This information is for the\ndesignated recipient only and may contain privileged, proprietary, or otherwise\nprivate information. If you are not the intended recipient of this information, you are\nhereby not ified that any use, distribution, copying, or disclosure of this\ncommunication is strictly prohibited. If you have received this information in error,\nplease notify the sender and purge the communication immediately.\"\n(3) A secondary metals recycler shall not purchase any restricted metals without\nobtaining reasonable proof that the seller owns the property, such as a receipt or bill\nof sale, or reasonable proof that the seller is an employee, agent, or contractor of a\ngovernmental entity, utility company, cemetery, railroad, manufacturer, or other\nperson, business, or entity owning the property and that the seller is authorized to\nsell the item of restricted metal. A secondary metals recycler may retain on file an\nofficial document on the letterhead of the person, business, or entity indicating that\nthe seller is authorized to sell the restricted metal item. Such a letter must be dated\nwithin three hundred sixty-five (365) days of the transaction.\n(4) The requirements for the purchase of restricted metals ac cording to the provisions\nof subsections (1) and (2) of this section shall also apply to the purchase of copper\nwire or coaxial cable belonging to a utility or cable provider, such as\ncommunication, transmission, distribution, or service wire, by a seconda ry metals\nrecycler.\n(5) The provisions of subsections (1) and (3) of this section shall not apply to\nnonreturnable used beverage containers.\n(6) The provisions of this section shall not apply to the following:\n(a) The purchase of restricted metals from a secondary metals recycler;\n(b) The purchase of restricted metals from an organization, corporation, or\nassociation registered with the Commonwealth as a charitable, philanthropic,\nreligious, fraternal, civic, patriotic, social, or school-sponsored organization;\n(c) The purchase of restricted metals pursuant to a written contract, from a\nmanufacturing, industrial, or other commercial vendor that generates restricted\nmetals in the ordinary course of business; or\n(d) A motor vehicle, aircraft, or other item that is licensed by the state or federal\ngovernment pursuant to a legitimate transfer of title or issuance of a junk title.","path":["KRS Chapter 433"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=40488","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:59:48Z","sha256":"5e6a6f234729615864655c33b03df34d9f1291c099cc0717430cf6f2d2a1c3a0","source_id":"us-ky","stale":false,"prev":"us-ky/krs-433.902","next":"us-ky/krs-433.906"},"notice":"GroundRules: Original legal text.
