{"data":{"id":"us-ky/krs-433.912","jurisdiction":"us-ky","citation":"KRS 433.912","heading":"Revocation or suspension of license -- Procedures -- Appeals.","body":"(1) A license issued by the commission may be revoked or suspended by the\ncommission, subject to appeal pursuant to KRS Chapter 13B, for the following\nreasons:\n(a) Fraud, misrepresenta tion, or false statement contained in the license\napplication;\n(b) Fraud, misrepresentation, or false statements made while conducting business\nas a secondary metals recycler;\n(c) A person is a fugitive or has been convicted of a criminal offense within th e\npreceding three (3) years involving business or commercial fraud, extortion,\nor receiving stolen property;\n(d) Any condition or fact that would have resulted in denial of the original license\napplication; or\n(e) Conducting business as a secondary metals recycler under this chapter in an\nunlawful manner or in a manner that endangers public health, safety, or\nwelfare.\n(2) The commission shall give reasonable notice of the revocation or suspension to the\nsecondary metals recycler at the address listed in the application for licensure.\n(3) Any secondary metals recycler whose license is revoked or suspended shall\nimmediately surrender the license to the commission.\n(4) If a licensee is a firm or corporation, it shall be sufficient cause for the denial,\nsuspension, or revocation of a license that any officer, director, or trustee of the\nfirm or corporation, or any member in case of a partnership, has been guilty of any\nact or omission which would be cause for refusing, suspending, or revoking a\nlicense to the par ty as an individual. Each licensee shall be responsible for the acts\nof any or all of his or her employees while acting as his or her agent, if the licensee\napproved of or had knowledge of the acts and after approval or knowledge retained\nthe benefit, proceeds, profits, or advantages accruing from the acts.\n(5) Final orders of the commission as a result of any hearing may be appealed to the\nFranklin Circuit Court in accordance with KRS Chapter 13B.","path":["KRS Chapter 433"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=57051","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:59:48Z","sha256":"7efb2026825a3f93979b6b98142d64bc83a5870ea85460155b3d9642bb403035","source_id":"us-ky","stale":false,"prev":"us-ky/krs-433.910","next":"us-ky/krs-433.914"},"notice":"GroundRules: Original legal text.
