{"data":{"id":"us-ky/krs-433.918","jurisdiction":"us-ky","citation":"KRS 433.918","heading":"Searchable electronic list of persons convicted of theft of metals -- Notice","body":"and opportunity for hearing -- Secondary metals recycler not to purchase or\nreceive from any person listed on registry.\n(1) A law enforcement agency shall provide to eac h secondary metals recycler within\nthe agency's jurisdiction a searchable electronic list of persons convicted of a theft\noffense in which metals were involved. The list shall be prepared in accordance\nwith rules adopted by the law enforcement agency and s hall be updated monthly.\nThe law enforcement agency may request the appropriate Circuit Court clerk to\nprovide the list.\n(2) The law enforcement agency shall transmit the list to the commission in an\nelectronic format consistent with rules adopted by the c ommission for inclusion in\nthe LeadsOnline database.\n(3) Before submitting the list to the LeadsOnline database, the commission shall give\nreasonable notice to each person on the list and an opportunity for the person to be\nheard. Hearings under this subse ction shall be governed by KRS Chapter 13B. A\nfinal order of the commission may be appealed to Franklin Circuit Court in\naccordance with KRS Chapter 13B.\n(4) (a) A secondary metals recycler shall not purchase or receive articles from any\nperson listed on t he electronic registry provided by the law enforcement\nagency.\n(b) A person who has appealed his or her inclusion on the registry shall not be\nprohibited from selling or giving articles to a secondary metals recycler unless\na final order has been entered a gainst the person.
