{"data":{"id":"us-ky/krs-434.225","jurisdiction":"us-ky","citation":"KRS 434.225","heading":"Removal, transfer, or abandonment of rented or leased personal property -","body":"- Attempt to defraud lessor.\n(1) As used in this section the following words shall have the following meanings:\n(a) \"Person\" means an individual, partnership, association or corporation;\n(b) \"Address\" means the place at which the rented or leased personal property is\nlocated;\n(c) \"Personal property\" means household furnishings and appliances.\n(2) A person who rents or leases personal property under an agreement to relinquish\npossession of such property to the lessor at the expiration of the lease or rental\nperiod, shall not, prior to the expiration of such period, remove the personal\nproperty to any other address and relinquish custody of such property without first\ngiving the lessor at least ten (10) days' written notice, delivered in person or by\ncertified mail with a return receipt requested.\n(3) Removing the personal property, or any part thereof, to a new or different location\nand relinquishing custody of such property, or permitting another person, not a party\nto the lease agreement, to take possession of the personal property, or any part\nthereof, or moving from the address and abandoning the personal property shall\nconstitute prima facie evidence of the lessee's intention to defraud the lessor.\n(4) Any lease under subsection (2) of this section shall recite verbatim subsections (1),\n(2), (3), and (4) of this section.\n(5) Failure of lessor to comply with subsection (4) of this section shall void lessor's\nrelief herein.\n(6) Any person described in subsection (2) of this section who attempts to defraud a\nlessor of leased personal property shall be fined not less than fifty dollars ($50) nor\nmore than two hundred dollars ($200), or imprisoned for thirty (30) days, or both.","path":["KRS Chapter 434"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=18856","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:59:49Z","sha256":"fb31bef26a18604d8c4cfc473fb301300ffbdb3f329fa6ba45531206abbd56a5","source_id":"us-ky","stale":false,"prev":"us-ky/krs-434.220","next":"us-ky/krs-434.230"},"notice":"GroundRules: Original legal text.
