{"data":{"id":"us-ky/krs-434.580","jurisdiction":"us-ky","citation":"KRS 434.580","heading":"Theft -- Receipt of stolen credit, debit, or gift card -- Presumption.","body":"(1) (a) A person who takes a credit, debit, or gift card from the person, possession,\ncustody, or control of another without the consent of the cardholder, the\nissuer, or, for a gift card, the merchant, or who, with knowledge that it has\nbeen so taken, receives the credit, debit, or gift card with intent to use it or to\nsell it or to transfer it to a person other than the issuer, the cardholder, or, for a\ngift card, the merchant, is:\n1. For a credit or debit card, subject to the penalties set forth in KRS\n434.730(1); or\n2. For a gift card, subject to the penalties set forth in KRS 514.030 for the\nface value of the gift card.\n(b) Taking a credit, debit, or gift card without c onsent includes obtaining it by\nconduct defined or known as statutory larceny, common -law larceny by\ntrespassory taking, common-law larceny by trick, embezzlement, or obtaining\nproperty by false pretenses, false promise, or extortion.\n(2) A person who has in his or her possession or under his or her control two (2) or\nmore credit, debit, or gift cards which have been taken or obtained in violation of\nsubsection (1) of this section is presumed to know that the credit, debit, or gift cards\nhave been so taken or obtained.","path":["KRS Chapter 434"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=56138","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:59:49Z","sha256":"a87db67326cdb22a764db88f38c50d56cb18f7977d6789caf1489139aa24e39c","source_id":"us-ky","stale":false,"prev":"us-ky/krs-434.570","next":"us-ky/krs-434.590"},"notice":"GroundRules: Original legal text.
