{"data":{"id":"us-ky/krs-434.655","jurisdiction":"us-ky","citation":"KRS 434.655","heading":"Fraudulent use of credit or debit card after reporting it lost, as stolen, or","body":"not received.\n(1) A cardholder who fraudulently uses a credit or debit card to obtain money, goods,\nservices, or anything else of value after said cardholder has re ported to the issuer\nsaid credit or debit card lost, as stolen, or not received is deemed to have used said\ncredit or debit card in order to defraud the issuer; and said cardholder shall be guilty\nof a Class B misdemeanor unless:\n(a) The value of all money , goods, services, or other things of value furnished in\nviolation of this section over a six (6) month period is five hundred dollars\n($500) or more but is less than one thousand dollars ($1,000), in which case it\nis a Class A misdemeanor;\n(b) The value of all money, goods, services, or other things of value furnished in\nviolation of this section over a six (6) month period is one thousand dollars\n($1,000) or more but is less than ten thousand dollars ($10,000), in which case\nit is a Class D felony;\n(c) The person has three (3) or more convictions under paragraph (a) of this\nsubsection within the last five (5) years, in which case it is a Class D felony.\nThe five (5) year period shall be measured from the dates on which the\noffenses occurred for which the judgments of conviction were entered; or\n(d) The value of all money, goods, services, or other things of value furnished in\nviolation of this section over a six (6) month period is ten thousand dollars\n($10,000) or more, in which case it is a Class C felony.\n(2) A cardholder who, after using a credit or debit card, fraudulently reports to the\nissuer that such usage or transaction was not made by said cardholder, or that said\ncredit or debit card was lost, stolen, or not received at the time of such usage or\ntransaction, in order to defraud the issuer, the cardholder, or any other person in\nconnection with said usage, shall be guilty of a Class B misdemeanor unless:\n(a) The value of all money, goods, services, or other things of value furnished in\nviolation of  this section over a six (6) month period is five hundred dollars\n($500) or more but is less than one thousand dollars ($1,000), in which case it\nis a Class A misdemeanor;\n(b) The value of all money, goods, services, or other things of value furnished in\nviolation of this section over a six (6) month period is one thousand dollars\n($1,000) or more but is less than ten thousand dollars ($10,000), in which case\nit is a Class D felony;\n(c) The person has three (3) or more convictions under paragraph (a) of thi s\nsubsection within the last five (5) years, in which case it is a Class D felony.\nThe five (5) year period shall be measured from the dates on which the\noffenses occurred for which the judgments of conviction were entered; or\n(d) The value of all money, g oods, services, or other things of value furnished in\nviolation of this section over a six (6) month period is ten thousand dollars\n($10,000) or more, in which case it is a Class C felony.","path":["KRS Chapter 434"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=51035","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:59:49Z","sha256":"1e6e111512b9417e46be24aaab9d2dffee45ed52a6238f0d1041506512f759ae","source_id":"us-ky","stale":false,"prev":"us-ky/krs-434.650","next":"us-ky/krs-434.660"},"notice":"GroundRules: Original legal text.
