{"data":{"id":"us-ky/krs-434.697","jurisdiction":"us-ky","citation":"KRS 434.697","heading":"Phishing.","body":"(1) For purposes of this section:\n(a) \"Electronic mail message\" means a message sent to a unique destination that\nconsists of a unique user name or mailbox and a reference to an Internet\ndomain, whether or not displayed, to which the message can be sent or\ndelivered; and\n(b) \"Identifying information\" means specific details that can be used to access a\nperson's financial accounts or to obtain goods or services, including but not\nlimited to the person's Social Security number, driver's license number, bank\naccount number, credit or debit card num ber, personal identification number,\nautomated or electronic signature, unique biometric data, or account\npassword.\n(2) A person is guilty of phishing if he or she knowingly or intentionally solicits,\nrequests, or takes any action to induce another person to provide identifying\ninformation by means of a Web page, electronic mail message, or otherwise using\nthe Internet, by representing himself or herself either directly or by implication, to\nbe a third person without the authority or approval of such other person.\n(3) In any prosecution for a violation of this section, the Commonwealth is not required\nto establish, and it is no defense that:\n(a) A person other than the defendant who violated this section has not been\nconvicted, apprehended, or identified; or\n(b) Some of the acts constituting a violation of this section did not occur in\nKentucky or were not a criminal offense or elements of a criminal offense\nwhere they did occur.\n(4) Phishing is a Class D felony.","path":["KRS Chapter 434"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=18911","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:59:49Z","sha256":"882904208680c195f72ce8f73580cbfd231c2707db195ec41d40d965e1ee55b5","source_id":"us-ky","stale":false,"prev":"us-ky/krs-434.695","next":"us-ky/krs-434.700"},"notice":"GroundRules: Original legal text.
