{"data":{"id":"us-ky/krs-434.710","jurisdiction":"us-ky","citation":"KRS 434.710","heading":"Sufficiency of evidence as to presumptions.","body":"When KRS 434.550 to 434.730 establishes a presumption with respect to any fact which\nis an element of a crime, it has the following consequences:\n(1) When there is sufficient evidence of the facts which give rise to the presumption to\ngo to the jury, the issue of the existence of the presumed facts must be submitted to\nthe jury, unless the court is satisfied that the evidence as a whole clearly negatives\nthe presumed facts; and\n(2) When the issue of the existence of the presumed fact is submitted to the j ury, the\ncourt shall charge that while the presumed fact, must, on all the evidence, be proven\nbeyond a reasonable doubt, the law declares that the jury may regard the facts giving\nrise to the presumption as sufficient evidence of the presumed fact.","path":["KRS Chapter 434"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=18913","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:59:49Z","sha256":"2651c799b640459de8bec1af167e3a1cd76ddbd1ef5216bb19a71737c749d37b","source_id":"us-ky","stale":false,"prev":"us-ky/krs-434.700","next":"us-ky/krs-434.715"},"notice":"GroundRules: Original legal text.
