{"data":{"id":"us-ky/krs-436.002","jurisdiction":"us-ky","citation":"KRS 436.002","heading":"Liability for failure to perform age verification to access matter harmful to","body":"minors -- Civil actions -- Applicability.\n(1) Any covered platform that knowingly and intentionally publishes or distributes\nmaterial on the internet, more than one -third (1/3) of which is matter harmful to\nminors, and fails to perform age verification, either by itself or through a third\nparty, of individuals attempting to access the matter shall be liable as provided in\nthis section.\n(2) Any person injured by a vio lation of this section, or a parent or legal guardian on\nbehalf of any minor injured by a violation of this section, may bring a civil action\nagainst the covered platform to recover:\n(a) Damages of ten thousand dollars ($10,000) per instance that the cover ed\nplatform failed to perform age verification to restrict the minor's access to\nmatter harmful to minors; and\n(b) Actual damages, court costs, and reasonable attorney's fees.\n(3) This section shall only apply to a minor who:\n(a) Is a permanent resident of this state;\n(b) Has resided in this state for more than one (1) year; or\n(c) Has been sojourning in this state for a period of at least thirty -one (31)\nconsecutive days.","path":["KRS Chapter 436"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=54995","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:59:50Z","sha256":"2919b7c4f8fb2d16f33654b3eb9867529150a87710bb7c082a6a1e42153a095e","source_id":"us-ky","stale":false,"prev":"us-ky/krs-436.001","next":"us-ky/krs-436.004"},"notice":"GroundRules: Original legal text.
