{"data":{"id":"us-ky/krs-436.006","jurisdiction":"us-ky","citation":"KRS 436.006","heading":"Civil actions -- Venue -- Defenses -- Enforcement by governmental entities","body":"or officers prohibited.\n(1) Any party filing a civil action under KRS 436.002 or 436.004 shall:\n(a) Bring the action in:\n1. The Circuit Court of the county where the alleged violation occurred;\n2. The Circuit Court of the county in which the person bringing the action\nresides; or\n3. Franklin Circuit Court; and\n(b) Have the right to a jury trial, and the jury shall decide both liability and\ndamages.\n(2) An individual may  bring an action under KRS 436.002 or 436.004 regardless of\nwhether another court has declared any provision of KRS 436.001 to 436.009\nunconstitutional, unless that court decision is binding upon the court in which the\naction is brought.\n(3) Nonmutual issue preclusion and nonmutual claim preclusion shall not be defenses\nto an action brought under KRS 436.002 or 436.004.\n(4) Notwithstanding any other law:\n(a) The requirements of KRS 436.001 to 436.009 sh all be enforced exclusively\nthrough private civil actions; and\n(b) Direct or indirect enforcement of KRS 436.001 to 436.009 shall not be taken\nor threatened by:\n1. The Commonwealth of Kentucky;\n2. A political subdivision of the Commonwealth;\n3. The Attorney General;\n4. A Commonwealth's attorney or county attorney; or\n5.
