{"data":{"id":"us-ky/krs-436.008","jurisdiction":"us-ky","citation":"KRS 436.008","heading":"Construction of KRS 436.001 to 436.009.","body":"(1) Nothing in KRS 436.001 to 436.009 shall be construed to impose liability on:\n(a) An internet service provider, or its affiliates or subsidiaries;\n(b) A general purpose search engine; or\n(c) A cloud service provider;\nwhen acting in its capacity as a provid er of those services to the extent the provider\nis not responsible for the creation of the content of the communication that\nconstitutes matter harmful to minors.\n(2) Nothing in KRS 436.001 to 436.009 shall be construed to limit or bar any cause of\naction or preclude the imposition of sanctions or penalties, including criminal\npenalties, that would otherwise be available under state or federal law.\n(3) Compliance with KRS 436.001 to 436.009 shall not excuse any person from any\nother legal duties or preclude any person from any other legal remedies.\n(4) KRS 436.001 to 436.009 shall not subject a covered platform to any cause of action\nor liability to the extent it is protected from causes of action or liability by federal\nlaw, including but not limited to 47 U.S.C. sec. 230.\n(5) The provisions of KRS 436.001 to 436.009 shall not apply in cases to the extent the\nprovisions would violate the Commerce Clause of the Constitution of the United\nStates.","path":["KRS Chapter 436"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=54998","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:59:50Z","sha256":"f694794d95adff1683502508defa12b04d03ca98aa488c204596f148c34152fc","source_id":"us-ky","stale":false,"prev":"us-ky/krs-436.006","next":"us-ky/krs-436.009"},"notice":"GroundRules: Original legal text.
