{"data":{"id":"us-ky/krs-436.009","jurisdiction":"us-ky","citation":"KRS 436.009","heading":"Waiver and estoppel of right to bring civil action are void.","body":"(1) A waiver, purported waiver, or estoppel of a person's right to bring a civil action\nunder KRS 436.002 or 436.004, or of any remedy or any other protection provided\nby KRS 436.00 1 to 436.009, shall be void and unenforceable as against public\npolicy, and a court or arbitrator shall not enforce or give effect to any waiver or\nestoppel, notwithstanding any choice -of-law or other provision in any contract or\nother agreement.\n(2) The waiver and estoppel prohibition under subsection (1) of this section:\n(a) Shall not apply to contractual waivers to the extent any application of the\nprohibition would impair the obligation of contract in violation of the\nConstitution of Kentucky or the Constitution of the United States;\n(b) Is a public policy limitation on contractual and other waivers or estoppels; and\n(c) Shall be enforced to the full extent permitted by the Constitution of Kentucky\nand the Constitution of the United States.\n(3) Any contr act, agreement, or arrangement made or entered in violation of KRS\n436.001 to 436.009 shall be void and unenforceable as against public policy.","path":["KRS Chapter 436"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=54999","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:59:50Z","sha256":"e7e584dfa813bb75f2a541c47ca9f2a7df85cfbaf3c423a3aa9ca85ef022d5ec","source_id":"us-ky","stale":false,"prev":"us-ky/krs-436.008","next":"us-ky/krs-436.010"},"notice":"GroundRules: Original legal text.
