{"data":{"id":"us-ky/krs-437.410","jurisdiction":"us-ky","citation":"KRS 437.410","heading":"Definitions.","body":"As used in KRS 437.410 to 437.429, unless the context otherwise requires:\n(1) \"Animal\" means any warm or cold blooded animal used in food or fiber production,\nagriculture, research, testing, or education, including poultry, fish, and insects;\n(2) \"Animal f acility\" means any vehicle, building, structure, or premises, where an\nanimal or animal records are kept, handled, housed, exhibited, bred, or offered for\nsale;\n(3) \"Consent\" means assent in fact, whether express or apparent;\n(4) \"Deprive\" means to withhol d an animal or other property from the owner\npermanently or for so extended a period of time that a major portion of the value or\nenjoyment of the animal or property is lost to the owner, to restore the animal or\nother property only upon payment of reward or other compensation, or to dispose of\nan animal or other property in a manner that makes recovery of the animal or\nproperty by the owner unlikely;\n(5) \"Effective consent\" means consent by a person legally authorized to act for the\nowner. Consent is not e ffective if induced by force, threat, false pretenses, or fraud,\nif given by a person the actor knows is not legally authorized to act for the owner, if\ngiven by a person who by reason of youth, mental disease or defect, or intoxication\nis known by the act or to be unable to make reasonable decisions, or if given solely\nto detect the commission of an offense;\n(6) \"Owner\" means a person who has title to the property, possession of the property,\nwhether lawful or not, or a greater right to possession of the property than the actor;\n(7) \"Person\" means any individual, corporation, association, nonprofit corporation,\njoint stock company, firm, trust, partnership, two (2) or more persons having a joint\nor common interest, or other legal entity;\n(8) \"Possession\" means actual care, custody, control, or management.","path":["KRS Chapter 437"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=19064","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:59:51Z","sha256":"141d4539ede8adbca5d13a24d52bd449ed4a52ae0ed81495445067a4b992967b","source_id":"us-ky","stale":false,"prev":"us-ky/krs-437.150","next":"us-ky/krs-437.415"},"notice":"GroundRules: Original legal text.
