{"data":{"id":"us-ky/krs-438.065","jurisdiction":"us-ky","citation":"KRS 438.065","heading":"Advertising or soliciting by practitioner of healing arts -- Exceptions.","body":"(1) No person licensed to practice medicine, dentistry, osteopathy, podiatry, optometry,\nor chiropractic, or any other healing art in this state shall solicit persons to become\npatients, or advertise by mail, card, newspaper, pamphlet, radio, television, o r any\nother medium, or permit his services to be advertised; provided, however, that such\nperson may publish a brief announcement of the opening of an office or of any\nchange of office location or change of office hours, and may cause to be listed in the\ntelephone directory and classified advertising sections thereof his name, address,\ntype of practice and office hours. Modest signs on the doors, windows, and walls of\nthe licensee's office or on the building in which he maintains an office setting out\nhis n ame, professional title in accordance with KRS 311.375, office hours and\naddress shall not be considered as violations of this subsection.\n(2) Each violation of subsection (1) of this section shall be punishable by a fine of not\nless than two hundred and f ifty dollars ($250) nor more than one thousand dollars\n($1,000) or by imprisonment for not less than one (1) month nor more than twelve\n(12) months or both.\n(3) Nothing contained herein prohibits the circulation of educational materials, which\nare not laud atory of the author or any person with whom he is associated in the\npractice of his profession, and which contain no solicitation of patients for the\nauthor or any such associate of the author, which has been approved as to content by\nthe appropriate licensing agency.","path":["KRS Chapter 438"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=19076","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:59:51Z","sha256":"03075d79be59776f2126eadb3acb4f79ad6c863262247de5326a6706357e386c","source_id":"us-ky","stale":false,"prev":"us-ky/krs-438.060","next":"us-ky/krs-438.070"},"notice":"GroundRules: Original legal text.
