{"data":{"id":"us-ky/krs-438.284","jurisdiction":"us-ky","citation":"KRS 438.284","heading":"New contracts for personal emergency response system services --","body":"Components -- Existing contracts.\n(1) Effective January 1, 2009, all new contracts between a personal emergency response\nsystem provider and a customer shall be in accordance with the following:\n(a) The customer shall designate in the contract the order in which responders are\nto be contacted in the event the personal emergency response system provider\nreceives an emergency alarm from the customer;\n(b) The customer may designate in the co ntract that, in response to receiving a\ncustomer's alarm, the first and primary contact for the dispatch of aid shall be\nfrom the personal emergency response system provider to a 911 center, public\nsafety answering point, or communications center in the ju risdiction from\nwhich the alarm was received;\n(c) The customer may designate in the contract that if, in response to receiving a\ncustomer's alarm, the personal emergency response system provider is not able\nto solicit a verbal response from the customer, t hen the personal emergency\nresponse system provider shall call the customer's 911 center, public safety\nanswering point, or communications center before contacting the customer's\ndesignated responders;\n(d) If the customer does not designate in the contract  a 911 center, public safety\nanswering point, or communications center as the primary responder, then the\ncustomer's 911 center, public safety answering point, or communications\ncenter shall become the default secondary responder after the personal\nemergency response system provider has attempted, without success, to notify\nall other responders designated by the customer;\n(e) The personal emergency response system provider shall provide a disclosure\nstatement to the customer that clearly states that the customer has the option to\ndesignate in the contract a 911 center, public safety answering point, or\ncommunications center as the primary responder. The customer shall\nacknowledge that he or she has read the disclosure statement by initialing,\nsigning, or checking a box on the disclosure statement;\n(f) If a 911 center, public safety answering point, or communications center is\ndesignated as a responder by the customer pursuant to this section, the\npersonal emergency response system provider shall provide that responder\nwith the name of the customer, the location from which the customer's alarm\nwas received, and such other information as may be requested by the 911\ncenter, public safety answering point, or communications center; and\n(g) Following any notification to the 911 center, public safety answering point, or\ncommunications center, the personal emergency response system provider\nshall attempt to notify the responders on the customer's calling list in\naccordance with the voice -to-voice request of the custome r or, if no\ninstructions are received from the customer, to the responders specified on the\ncalling list in the order specified by prior written instructions of the customer.\n(2) For contracts existing between a personal emergency response system provider and\na customer prior to January 1, 2009:\n(a) A personal emergency response system provider shall, by January 1, 2009:\n1. Mail a notice to each customer giving the customer the option of adding\na 911 center, public safety answering point, or communications center as\nthe primary responder as provided in this section; and\n2. Provide the customer with a toll -free number by which to contact the\npersonal emergency response system provider in order to establish a\nmodified protocol for the customer; and\n(b) If the customer does not contact the personal emergency response system\nprovider to change his or her protocol, the existing protocol shall remain in\nplace between the customer and the personal emergency response system\nprovider.","path":["KRS Chapter 438"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=19100","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:59:52Z","sha256":"f818ca13232a482cf4f913f1e127e7b867165900ac5f7e1d300307c43b1662cc","source_id":"us-ky","stale":false,"prev":"us-ky/krs-438.282","next":"us-ky/krs-438.286"},"notice":"GroundRules: Original legal text.
