{"data":{"id":"us-ky/krs-438.3061","jurisdiction":"us-ky","citation":"KRS 438.3061","heading":"Tobacco, nicotine, or vapor product license requirement -- Temporary","body":"license -- Penalties.\n(1) On or after July 1, 2026, a person, firm, or corporation shall not operate as a retailer\nselling alternative nicotine products, tobacco products , or authorized nicotine vapor\nproducts in or on any premises in the Commonwealth without first obtaining a\ntobacco, nicotine, or vapor product license issued by the department. The\ndepartment may issue:\n(a) A tobacco, nicotine, or vapor product license that may be renewed annually;\n(b) 1. A temporary tobacco, nicotine, or vapor product license for use at fairs,\nfestivals, and other similar events.\n2. A temporary license issued under this paragraph shall be valid for no\nmore than thirty (30) days.\n3. The department shall approve or deny every application for a temporary\ntobacco, nicotine, or vapor product license within fourteen (14) business\ndays; and\n(c) Any other special or temporary license the department deems necessary.\n(2) (a) Any person who, by himse lf or herself or through another, directly or\nindirectly, violates subsection (1) of this section shall be subject to the\npenalties in KRS 243.990(2).\n(b) On and after November 1, 2026, the department shall confiscate all alternative\nnicotine products, tobacco products, or authorized nicotine vapor products\nfrom any person, firm, or corporation that violates subsection (1) of this\nsection.","path":["KRS Chapter 438"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=56791","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:59:52Z","sha256":"61309ebdcb6bad9e19c86029eb01eac49bd691a702d325c1ca16695f8fe02cc0","source_id":"us-ky","stale":false,"prev":"us-ky/krs-438.306","next":"us-ky/krs-438.3063"},"notice":"GroundRules: Original legal text.
