{"data":{"id":"us-ky/krs-438.315","jurisdiction":"us-ky","citation":"KRS 438.315","heading":"Sales of tobacco products, alternative nicotine products, or vapor products","body":"to or purchases by persons under age 21 from vending machine prohibited --\nLocation of vending machine -- Penalty -- Issuance of uniform citation.\n(1) The sale of tobacco  products, alternative nicotine products, or vapor products\ndispensed through a vending machine is prohibited to any person under the age of\ntwenty-one (21) years.\n(2) The purchase of tobacco products, alternative nicotine products, or vapor products\ndispensed through a vending machine is prohibited to any person under the age of\ntwenty-one (21) years.\n(3) Except for vending machines located in factories or vending machines located in\nbars or taverns to which minors are not permitted access, any vending mac hine\nfrom which tobacco products, alternative nicotine products, or vapor products are\ndispensed shall be located in the line of sight of the cashier for the retail\nestablishment.\n(4) Any owner of a retail establishment violating this section shall be subj ect to a fine\nof not less than one hundred dollars ($100) nor more than five hundred dollars\n($500) for each violation. The fine shall be administered by the Department of\nAlcoholic Beverage Control using a civil enforcement procedure for persons\neighteen (18) years of age or older.\n(5) All peace officers with general law enforcement authority and employees of the\nDepartment of Alcoholic Beverage Control may issue a uniform citation, but may\nnot make an arrest, or take a child into custody, for a violation of this section.","path":["KRS Chapter 438"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=49835","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:59:52Z","sha256":"7e0b6a688fe5f5ed07898c5b91086e085e903c1ff02fcd3746ba77e8dad3a69c","source_id":"us-ky","stale":false,"prev":"us-ky/krs-438.313","next":"us-ky/krs-438.316"},"notice":"GroundRules: Original legal text.
