{"data":{"id":"us-ky/krs-438.350","jurisdiction":"us-ky","citation":"KRS 438.350","heading":"Prohibition against possession or use of tobacco products, alternative","body":"nicotine products, or vapor products by persons under age 21 -- Exceptions --\nPenalties.\n(1) No person under the age of twenty -one (21) shall possess or use tobacco produc ts,\nalternative nicotine products, or vapor products.\n(2) Any tobacco product, alternative nicotine product, or vapor product found in the\npossession of a person under the age of twenty -one (21) and in plain view of the\nlaw enforcement officer shall be confiscated by the law enforcement officer making\nthe charge.\n(3) Any person under the age of twenty -one (21) found possessing or consuming an\nalternative nicotine product, tobacco product, or vapor product may be required to\nparticipate in a community service program or attend a tobacco cessation program.\n(4) This section shall not apply to persons exempted as provided by KRS 438.311 and\n438.330.","path":["KRS Chapter 438"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=56249","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:59:52Z","sha256":"a6471be275b541b4057ad97dcedfd2e6742d7b0afd78bbb42372e9c9550a39a7","source_id":"us-ky","stale":false,"prev":"us-ky/krs-438.345","next":"us-ky/krs-439.010"},"notice":"GroundRules: Original legal text.
