{"data":{"id":"us-ky/krs-439.250","jurisdiction":"us-ky","citation":"KRS 439.250","heading":"Definitions for KRS 439.250 to 439.560.","body":"As used in KRS 439.250 to 439.560, unless the context requires otherwise:\n(1) \"Secretary\" means the secretary of the Justice and Public Safety Cabinet;\n(2) \"Commissioner\" means the commissioner of the Department of Corrections;\n(3) \"Department\" means the Department of Corrections;\n(4) \"Deputy commissioner\" means the deputy commissioner of the Office of Adult\nInstitutions or the deputy commissioner of the Office of Community Services and\nFacilities of the Department of Corrections;\n(5) \"Board\" means the Parole Board created by KRS 439.320;\n(6) \"Community supervision\" means:\n(a) The placement of a defendant under supervision with conditions imposed by a\ncourt for a specified period during which:\n1. Criminal proceedings are deferred without an adjudication of guilt; or\n2. A sentence of imprisonment or confinement, imprisonment and fine, or\nconfinement and fine, is probated and the imposition of sentence is\nsuspended in whole or in part; or\n(b) The placement of an individual under supervision after release from p rison or\njail, with conditions imposed by the board for a specified period;\n(7) \"Parole compliance credit\" means a credit on a paroled individual's sentence for\nprogram credit, work -for-time credit, educational accomplishment, or meritorious\nservice and sh all be calculated pursuant to the applicable provisions in KRS\n197.045 and 197.047;\n(8) \"Probation program credit\" means a credit on the sentence of a supervised\nindividual who is on probation, probation with an alternative sentence, or\nconditional discharge for educational credit, program completion credit, or work -\nfor-time credit calculated pursuant to KRS 439.268;\n(9) \"Supervised compliance credit\" means a credit on a paroled individual's sentence\nfor compliance with supervision that shall be calculated pursuant to KRS 439.345;\n(10) \"Positive reinforcement\" means any of a wide range of rewa rds and incentives,\nincluding but not limited to awarding certificates of achievement, reducing\nreporting requirements, deferring a monthly supervision fee payment, removing\nsupervision conditions such as home detention or curfew, or asking the supervised\nindividual to be a mentor to others;\n(11) \"Probation and parole district supervisor\" means the highest ranking field probation\nor parole administrator in each district; and\n(12) \"Supervised individual\" means an individual placed on probation, probation with an\nalternative sentence, or conditional discharge by a court or serving a period of\nparole or post-release supervision from prison or jail.","path":["KRS Chapter 439"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=50184","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:59:53Z","sha256":"988829f6d8d100916eb2e83fbd86c84335b9713a465a4b3a829f1d28fa2ccdac","source_id":"us-ky","stale":false,"prev":"us-ky/krs-439.240","next":"us-ky/krs-439.260"},"notice":"GroundRules: Original legal text.
