{"data":{"id":"us-ky/krs-439.268","jurisdiction":"us-ky","citation":"KRS 439.268","heading":"Probation program credits.","body":"(1) Any supervised individual on probation, probation with an alternative sentence, or\nconditional discharge shall receive credit on his or her sentence for:\n(a) Successfully receiving a High School Equivalency Diploma or a high school\ndiploma, a college degre e, a completed vocational or technical education\nprogram, or a correspondence postsecondary education program which results\nin a diploma or degree, as defined and approved by the department in the\namount of ninety (90) days per diploma, degree, or vocation al or technical\neducation program completed;\n(b) Successfully completing a drug treatment program, evidence -based program,\nor any other promising practice or life skills program approved by the\ndepartment, in the amount of not more than ninety (90) days fo r each program\ncompleted. The department shall determine criteria to establish whether a life\nskills or promising practice program is eligible for probation program credits.\nPrograms shall demonstrate learning of skills necessary for reintegration into\nthe community to minimize barriers to successful reentry. Approval of\nprograms shall be subject to review by the department; and\n(c) Work-for-time credit, which shall be applied for any public employment, at\nthe same rates as calculated pursuant to KRS 197.047.\n(2) Probation program credits earned pursuant to subsection (1) of this section shall be\napplied to reduce the period of probation, probation with an alternative sentence, or\nconditional discharge ordered by the sentencing court.\n(3) No less than ninety  (90) days before the projected date of final discharge, the\ndepartment shall notify the sentencing court of probation program credits awarded\npursuant to this section and that the period of supervision is reduced by the number\nof days of probation program  credits earned by the supervised individual, and the\nimpending discharge from supervision. If the sentencing court, upon receiving such\nnotice does not take any action pursuant to KRS 533.020, the offender shall be\ndischarged.\n(4) The department may promu lgate administrative regulations for the awarding of\nprobation program credits.\n(5) For supervised individuals on supervision prior to July 15, 2020, probation program\ncredits shall begin to accrue on the first day of the first month after July 15, 2020.","path":["KRS Chapter 439"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=50183","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:59:53Z","sha256":"87c50a88e456bd17b31c0e3bf3190d189544babb20d587f3c1ca2980834a7a89","source_id":"us-ky","stale":false,"prev":"us-ky/krs-439.267","next":"us-ky/krs-439.270"},"notice":"GroundRules: Original legal text.
