{"data":{"id":"us-ky/krs-439.3101","jurisdiction":"us-ky","citation":"KRS 439.3101","heading":"Administrative regulations requiring supervision and treatment in","body":"accordance with evidence-based practices.\n(1) The department shall promulgate administrative regulations that require the\nsupervision and treatment of supervised individuals in accorda nce with evidence -\nbased practices.\n(2) The administrative regulations shall, at a minimum, include:\n(a) The administration of a validated risk and needs assessment on all supervised\nindividuals at regular intervals to determine their criminal risk factors and to\nidentify intervention targets;\n(b) Use of assessment scores and other objective criteria throughout the period of\ncommunity supervision to determine the risk level and program needs of each\nsupervised individual;\n(c) Caseload size guidelines that ar e based on supervised individuals' risk levels\nand take into account department resources and employee workload and\nprioritization of supervision and program resources for supervised individuals\nwho are at higher risk to reoffend;\n(d) Definitions of various risk levels to apply to supervised individuals during the\nperiod of community supervision;\n(e) Development of a case plan for each individual who is assessed to be\nmoderate-to-high risk based on the risk and needs assessment, that targets the\ncriminal risk factors identified in the assessment, is responsive to individual\ncharacteristics, and provides supervision of offenders according to that case\nplan;\n(f) Implementation of swift, certain, proportionate, and graduated sanctions that a\nprobation and parol e officer shall apply in response to a supervised\nindividual's noncompliant behaviors; and\n(g) Establishment of protocols and standards that assess the degree to which\npolicies, procedures, programs, interventions, and practices relating to\noffender recidivism reduction, whether utilized by the department or contract\nor referral agencies, are evidence-based.","path":["KRS Chapter 439"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=39568","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:59:53Z","sha256":"96b8889c63145f4fb61c88ead0dd58c4c971574b1dcfb7f3e0ae609ff0d87edc","source_id":"us-ky","stale":false,"prev":"us-ky/krs-439.310","next":"us-ky/krs-439.3102"},"notice":"GroundRules: Original legal text.
