{"data":{"id":"us-ky/krs-439.3103","jurisdiction":"us-ky","citation":"KRS 439.3103","heading":"Annual report on efforts to implement evidence-based practices to reduce","body":"recidivism -- Administrative regulations.\n(1) By December 1 of each year the department shall submit to the Governor, the\nLegislative Research Commission for referral  to the Interim Joint Committee on\nJudiciary, and the Chief Justice a comprehensive report on its efforts to implement\nevidence-based practices to reduce recidivism. The report shall include at a\nminimum:\n(a) The percentage of supervised individuals being supervised in accordance with\nevidence-based practices;\n(b) The percentage of state moneys expended by the department for programs that\nare evidence based, and a list of all programs with identification of which are\nevidence based;\n(c) Specification of supervision policies, procedures, programs, and practices that\nwere created, modified, or eliminated;\n(d) The department's recommendations for resource allocation, and any additional\ncollaboration with other state, regional, or local public agencies, private\nentities, or faith-based and community organizations;\n(e) A length of stay report on time served by first time incarcerated individuals\nreleased from the department's custody, which shall include for each offense\nthe:\n1. Number of persons released;\n2. Average sentence in days;\n3. Average time served in days;\n4. Average percentage of the sentence served;\n5. Percentage of persons released on supervision; and\n6. Number of persons released who were serving a life sentence or a life\nsentence without benefit of probation or parole until he or she has served\na minimum of twenty -five (25) years of his or her sentence, and the\naverage time served in days; and\n(f) A repo rt on persons released from the department's custody on supervision\nthat shall include the following:\n1. Demographic information, including but not limited to:\na. Gender;\nb. Race;\nc. Age group at the time of release;\nd. Parental status, and if the person i s a parent, whether he or she has\nany form of custody of his or her children; and\ne. Gang affiliation;\n2. Case information, including but not limited to:\na. Education level upon release;\nb. The number of dependents upon release;\nc. The crime of conviction;\nd. Whether the person was sentenced on or after July 15, 2024; and\ne. The number of days in custody prior to release;\n3. Count of:\na. Prior community supervision periods; and\nb. Community supervision revocations;\n4. Conditions of supervision, including but not limited to:\na. Mental health or substance abuse programming;\nb. Cognitive skills or education programming; and\nc. Any other condition of supervision;\n5. Supervision activities, including but not limited to:\na. The number of technical violations;\nb. The number of nontechnical violations;\nc. The number of drug tests;\nd. The percentage or number of positive drug tests;\ne. The number of program completions while on supervision for\nwhich the offender received good time credits and attendance has\nbeen verified;\nf. The number of jobs per year while on parole and the percentage of\ndays employed while on parole; and\ng. The number of residence changes to a new zip code during parole;\n6. Prior criminal history, including the number of prior arrests and\nconvictions; and\n7. Rates of recidivism.\n(2) The department shall:\n(a) Collect all data necessary to prepare the report and may prom ulgate\nadministrative regulations in accordance with KRS Chapter 13A to implement\nthis section; and\n(b) Make the full report and an executive summary available to the general public\non its website.","path":["KRS Chapter 439"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=56660","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:59:53Z","sha256":"a2cbadee20314063f2b05d516bfbb4e3dbeb90567112413ee295ec6819d47e7f","source_id":"us-ky","stale":false,"prev":"us-ky/krs-439.3102","next":"us-ky/krs-439.3104"},"notice":"GroundRules: Original legal text.
