{"data":{"id":"us-ky/krs-439.3104","jurisdiction":"us-ky","citation":"KRS 439.3104","heading":"Duties of department concerning risk and needs assessment instrument.","body":"The department shall:\n(1) Conduct an initial administration of a validated risk and needs assessment\ninstrument on an individual upon intake to community supervision, unless an initial\nassessment has been previously conducted within a reasonable time perio d as\nspecified in department regulations;\n(2) While the individual is on community supervision, readminister the risk and needs\nassessment at regular intervals as determined by administrative regulations\npromulgated pursuant to KRS 439.3101;\n(3) Apply the results of the risk and needs assessment to:\n(a) Establish an appropriate level of supervision;\n(b) Determine the content of a case plan that addresses the supervised individual's\ncriminal needs; and\n(c) Respond to compliant and noncompliant behavior; and\n(4) Promulgate administrative regulations to determine appropriate levels of\nsupervision, guidelines for case planning, and guidelines for responses to specified\nbehavior by supervised individuals.","path":["KRS Chapter 439"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=39571","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:59:53Z","sha256":"a6ce189d788463d3cefa39fe57d800de7a514d51d18008fa8d5c37cfeb6d6b20","source_id":"us-ky","stale":false,"prev":"us-ky/krs-439.3103","next":"us-ky/krs-439.3105"},"notice":"GroundRules: Original legal text.
