{"data":{"id":"us-ky/krs-439.3105","jurisdiction":"us-ky","citation":"KRS 439.3105","heading":"Administrative caseload supervision program for supervised offenders --","body":"Administrative regulations.\n(1) The department shall promulgate administrative regulations in accordance with the\nprovisions of this section to establish an administrative caselo ad supervision\nprogram for supervised individuals whose results from a risk and needs assessment\nindicate that they are low-risk offenders.\n(2) The administrative caseload supervision program shall consist of monitoring\nsupervised individuals to ensure that they have not engaged in new criminal activity\nand are fulfilling financial obligations to the court.\n(3) If a supervised individual on administrative caseload supervision:\n(a) Does not fulfill his or her restitution or other financial obligations to the court,\nhe or she may be placed on a higher level of supervision at the discretion of\nthe department; or\n(b) Engages in criminal activity, he or she may be prosecuted, revoked, or placed\non a higher level of supervision; or\n(c) Exhibits signs or symptoms o f a substance abuse disorder, he or she may be\nassessed by the Administrative Office of the Courts drug court personnel for\nconsideration of admission into drug court.\n(4) A supervised individual on a higher level of supervision who demonstrates a\nreduction in criminal risk factors upon reassessment and who has achieved the goals\nestablished in his or her case plan may be placed on administrative caseload\nsupervision at the discretion of the department.\n(5) A supervised individual on a higher level of super vision shall presumptively be\nplaced on administrative supervision if he or she has:\n(a) Completed twelve (12) months of community supervision;\n(b) Not violated the terms of his or her community supervision in the previous\ntwelve (12) months;\n(c) Fulfilled all restitution and other financial obligations to the court;\n(d) Demonstrated a reduction in criminal risk factors upon reassessment; and\n(e) Achieved the goals established in his or her case plan.\n(6) If the conditions or level of community supervision of a probationer are modified\nunder this section, the probation and parole officer shall file a copy of the modified\nconditions or level with the sentencing court.\n(7) The department may establish by administrative regulation conditions for overriding\npresumptive administrative supervision.","path":["KRS Chapter 439"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=39575","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:59:53Z","sha256":"a86d5b3714c46a1ffe4cfd6c0403139c2939e921b3a7da6042e04248729842a8","source_id":"us-ky","stale":false,"prev":"us-ky/krs-439.3104","next":"us-ky/krs-439.3106"},"notice":"GroundRules: Original legal text.
