{"data":{"id":"us-ky/krs-439.3107","jurisdiction":"us-ky","citation":"KRS 439.3107","heading":"System of graduated sanctions for violations of conditions of community","body":"supervision -- Administrative regulations.\n(1) The department shall, by January 1, 2012, adopt a system of graduated sanctions for\nviolations of conditions of community supervisi on. Notwithstanding KRS Chapter\n533, the system shall set forth a menu of presumptive sanctions for the most\ncommon types of supervision violations, including but not limited to: failure to\nreport; failure to pay fines, fees, and victim restitution; failur e to participate in a\nrequired program or service; failure to complete community service; violation of a\nprotective or no contact order; and failure to refrain from the use of alcohol or\ncontrolled substances. The system of sanctions shall take into accoun t factors such\nas the severity of the current violation, the supervised individual's previous criminal\nrecord, the number and severity of any previous supervision violations, the\nsupervised individual's assessed risk level, and the extent to which graduate d\nsanctions were imposed for previous violations. The system also shall define\npositive reinforcements that supervised individuals may receive for compliance with\nconditions of supervision.\n(2) The department shall establish by administrative regulation an  administrative\nprocess to review and approve or reject, prior to imposition, graduated sanctions\nthat deviate from those prescribed.\n(3) The department shall establish by administrative regulation an administrative\nprocess to review graduated sanctions co ntested by supervised individuals under\nKRS 439.3108.","path":["KRS Chapter 439"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=39577","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:59:53Z","sha256":"a8ed536fecd67fe4418a375c9d51d3289065b0ba9713bb56d2c6361c0943fde7","source_id":"us-ky","stale":false,"prev":"us-ky/krs-439.3106","next":"us-ky/krs-439.3108"},"notice":"GroundRules: Original legal text.
