{"data":{"id":"us-ky/krs-439.3403","jurisdiction":"us-ky","citation":"KRS 439.3403","heading":"Reconsideration of parole of inmate given deferment or serve -out longer","body":"than sixty months -- Exceptions -- Hearings.\n(1) Except as provided in subsection (2) of this section, the board shall reconsider the\nparole of any prisoner as of June 8, 2011, w ho was given a deferment or serve -out\nof longer than sixty (60) months at the prisoner's most recent parole hearing.\n(2) No reconsideration shall be required under this section for any prisoner who has\nreceived a deferment or serve-out of longer than sixty (60) months if:\n(a) The deferment or serve-out was approved by a majority vote of the full board;\nor\n(b) The prisoner stands convicted of a criminal offense currently defined as a\nviolent offense in KRS 439.3401 or as a sex crime in KRS 17.500, regardless\nof the date the crime was committed or the date of conviction.\n(3) The board shall schedule parole hearings for prisoners eligible for reconsideration\nof parole under this section according to the following schedule:\n(a) For a prisoner who has served less  than sixty (60) months of his or her\nsentence as of June 8, 2011, the board shall schedule and conduct a parole\nhearing during the month the prisoner has served sixty (60) months of his or\nher sentence; and\n(b) For a prisoner who has served more than sixt y (60) months of his or her\nsentence as of June 8, 2011, the board shall schedule and conduct a parole\nhearing within twelve (12) months of June 8, 2011.\n(4) The department shall provide all necessary assistance and information to the board\nin accordance with KRS 439.340 in order for the board to conduct timely hearings\nunder subsection (1) of this section.\n(5) Parole hearings required under subsection (1) of this section shall be conducted in\naccordance with and subject to the provisions of KRS 439.250 to 439.560,\nincluding but not limited to the requirements relating to notification of victims, the\nauthority of the board to conduct hearings by panels of the board, and the\nrequirement to keep records relating to the hearings.","path":["KRS Chapter 439"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=39553","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:59:53Z","sha256":"f840de1809850bd0037833a0a81b7012f5cb7f606a3745b733a4cbe10f964167","source_id":"us-ky","stale":false,"prev":"us-ky/krs-439.3402","next":"us-ky/krs-439.3405"},"notice":"GroundRules: Original legal text.
