{"data":{"id":"us-ky/krs-439.563","jurisdiction":"us-ky","citation":"KRS 439.563","heading":"Restitution as condition of parole -- Board order -- Effect on length of","body":"parole.\n(1) When there is an identified victim of a defendant's crime to whom restitution has\nbeen ordered but not yet paid in full, or restitution has been ordered paid to a\ngovernment agency and has not yet been paid in full, the Parole Board shall order\nthe defendant to pay restitution as a condition of parole.\n(2) When the Parole Board orders restitution, the board shall:\n(a) Order the restitution to be paid to a specific person or organization through the\nDivision of Probation and Parole, which shall disburse the moneys as ordered\nby the board;\n(b) Set the amount of restitution to be paid, if not already set;\n(c) Set the amount and frequency of each restitution payment or requ ire the\npayment to be made in a lump sum.\n(3) When the Parole Board orders restitution, the Department of Probation and Parole\nshall:\n(a) Monitor and oversee the collection of the restitution;\n(b) Institute parole violation proceedings if the restitution is not being paid;\n(c) Institute sanctions against the defendant if restitution is not being paid and\ngood cause is not shown for the nonpayment; and\n(d) Maintain parole supervision over the defendant until restitution has been paid\nin full.\n(4) The board, in addition to any other sanctions which may be imposed on the\ndefendant, may ask a court to hold a defendant who is not paying restitution in the\nmanner or amount prescribed in contempt of court.\n(5) Any statute relating to the length of parole supervisio n notwithstanding, the parole\nfor a person owing restitution shall be until the restitution is paid in full, even if this\nwould lengthen the period of supervision beyond the statutory limit of parole\nsupervision or the statutory limit for serving out the sentence imposed.\n(6) Payment of restitution in full prior to the end of the period of parole supervision\nshall not shorten the period of parole supervision.","path":["KRS Chapter 439"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=43382","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:59:53Z","sha256":"564b8791f7ff096e2993edfbc16568c9f8a23f650a3ed3089e250a4d0abab8a9","source_id":"us-ky","stale":false,"prev":"us-ky/krs-439.562","next":"us-ky/krs-439.570"},"notice":"GroundRules: Original legal text.
