{"data":{"id":"us-ky/krs-439.575","jurisdiction":"us-ky","citation":"KRS 439.575","heading":"Prerelease probation of inmates program.","body":"(1) There is hereby created a program for prerelease probation of inmates confined in\ncorrectional facilities under the jurisdiction of or under contract to the Department\nof Corrections.\n(2) Any inmate who is in a prerelease program or eligible for a prerelea se program as\nspecified by administrative regulations of the Department of Corrections may apply\nto the sentencing court for prerelease probation.\n(3) The court, upon favorable recommendation of the Department of Corrections, may\nplace the inmate on probat ion under those terms and conditions the court deems\nnecessary, which may include but not need to be limited to those specified in KRS\n533.030.\n(4) In particular, the court may require that an inmate placed on prerelease probation\nremain in a halfway house  approved by the Department of Corrections and that the\nprobationer pay the cost of his or her lodging in the halfway house and the costs of\nprobation supervision in accordance with applicable statutes for probation\nsupervision and persons granted work rel ease from jail. Costs for lodging in a\nhalfway house or other facility approved, but not operated, by the Department of\nCorrections shall be paid by the defendant directly to the halfway house or other\nfacility at the rate specified by court order or by the Department of Corrections.\n(5) An inmate placed on prerelease probation shall no longer be considered as an\ninmate of the Department of Corrections but shall be considered as a defendant\nplaced on probation, subject to supervision by the Division of Prob ation and Parole,\nor other agency approved by the court, and the orders of the court.\n(6) A person placed on prerelease probation by the court who violates the conditions of\nhis or her probation may be dealt with by the court in the same manner as any othe r\nperson who violates the conditions of probation.\n(7) The period of probation under this section shall not exceed the maximum expiration\ndate of the inmate applying for the probation.","path":["KRS Chapter 439"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=19212","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:59:53Z","sha256":"c9bd0d40faee0d319bdbc15cf01fcbd59741fc7292bc24b9b1c0b30e22dcf209","source_id":"us-ky","stale":false,"prev":"us-ky/krs-439.570","next":"us-ky/krs-439.580"},"notice":"GroundRules: Original legal text.
