{"data":{"id":"us-ky/krs-439.652","jurisdiction":"us-ky","citation":"KRS 439.652","heading":"Administration and  oversight of pilot program  -- Reentry team","body":"members,  training, and  functions -- Confidentiality of proceedings  --\nException.\n(1) The  reentry team shall administer and oversee the reentry drug supervision\npilot program. The team shall consist of the following members:\n(a) A department hearing officer shall lead the reentry team and ensure that\ndue process is followed. If reentry team members  disagree on incentives\nor sanctions, the hearing officer shall be the final decision maker;\n(b) A  parole officer who shall have regular parole officer duties, including\ndrug testing and maintaining records;\n(c) A reentry liaison or facilitator from the Division of Probation and Parole;\n(d) A social service clinician;\n(e) A  public defender or his or her designated representative who may  or\nmay  not be an attorney; and\n(f) A designated representative from a community mental health center who\nshall provide substance use disorder treatment to participants.\n(2) The  Administrative Office of the Courts shall train reentry team members  on\nthe philosophy behind drug courts as well as their roles within the team.\n(3) The  reentry team may  provide incentives, including but not limited to the\nfollowing:\n(a) Promotion to the next phase as outlined in KRS 439.654;\n(b) Certificates and tokens;\n(c) Compliance  credit or any other parole credit approved by the reentry\nteam;\n(d) Decreased supervision;\n(e) Increased privileges and responsibilities;\n(f) Praise from the hearing officer and reentry team;\n(g) Extended curfews; and\n(h) Other individual incentives approved by the reentry team.\n(4) (a) Notwithstanding KRS  439.3108 or 439.340(3)(b) or any other statute to\nthe contrary, only the reentry team may impose sanctions on participants\nwho  do not comply with the requirements and conditions established by\nthe reentry team. Notwithstanding KRS  439.3107 or 439.3108 or any\nother statute to the contrary, sanctions include but are not limited to the\nfollowing:\n1. Admonishments  by the hearing officer;\n2. Graduated  sanctions similar to those adopted by the department\npursuant to KRS 439.3107;\n3. Community  service;\n4. Phase demotion;\n5. Increased pilot program requirements;\n6. Electronic monitoring;\n7. Home  incarceration;\n8. Imprisonment in a state or local correctional or detention facility or\nresidential center for no more than sixty (60) days in any one (1)\ncalendar year; and\n9. Termination from the pilot program.\n(b) When  considering appropriate sanctions, the reentry team shall consider\nalternatives to incarceration.\n(c) Notwithstanding paragraph (a) of this subsection, a parole officer may\narrest a participant without first consulting the reentry team if the parole\nofficer believes the participant poses an imminent threat to himself or\nherself or to others. The parole officer shall immediately notify the reentry\nteam  of the arrest. Upon receiving notification of the arrest, the reentry\nteam shall then determine whether to impose additional sanctions.\n(5) Reentry team proceedings shall be confidential and shall be closed unless\notherwise authorized by the hearing officer. Each reentry team member  shall\nsign a confidentiality agreement and shall comply with state and federal\nconfidentiality laws regarding treatment information.
