{"data":{"id":"us-ky/krs-44.030","jurisdiction":"us-ky","citation":"KRS 44.030","heading":"Money not to be paid to state or local government debtor -- Priority of","body":"multiple claims -- Matching child support obligors and claimants --\nInformation on debts referred to Department of Revenue to be provided to\nState Treasurer.\n(1) No money shall be paid to any person on a claim against the state in his or her own\nright, or as an assignee of another, when the person or the person's assignor is\nindebted to the state or any local government. The claim, to the extent it is allowed,\nshall first be credited to the account of the person indebted to the state, and if there\nis any balance due the person after settling the whole demand of the state, any\ncertified liquidated debts of any local government shall be paid if the local\ngovernment provide s information concerning the liquidated debt to the State\nTreasurer. If there is any balance due the person after settling the whole demand of\nthe state or local governments, and if there are not liquidated debts certified against\nthe claim pursuant to KRS 44.065, that balance shall be paid to the person.\n(2) In case of multiple claims by state agencies, the claims shall be paid as follows:\n(a) First, to any claim made by the Office of the Attorney General for past due\nchild support obligations;\n(b) Second, to any claim filed by the Finance and Administration Cabinet,\nDepartment of Revenue, for taxes owed the Commonwealth; and\n(c) Third, to all other state agencies in the order that the claims were filed with\nthe State Treasury.\n(3) In the case of multiple c laims filed by any local government, the claims shall be\npaid in the order that the claims were filed with the State Treasury.\n(4) No money shall be paid to any person on a claim against a local government in his\nor her own right, or as an assignee of anot her, when the person or the person's\nassignor is indebted to the local government or the state. The claim, to the extent it\nis allowed, shall first be credited to any debt of the person indebted to the local\ngovernment, and if there is any balance due the person after settling the whole\ndemand of the local government, any certified liquidated debts of the state shall be\npaid if the state provides the local government with information concerning the\nliquidated debt. If there is any balance due the person aft er settling the whole\ndemand of the local government or the state, that balance shall be paid to the\nperson.\n(5) The Finance and Administration Cabinet shall provide the Office of the Attorney\nGeneral with a quarterly report of all tort claims made against  the state by\nindividuals that the Office of the Attorney General shall compare with the child\nsupport database to match individuals who have a child support arrearage and may\nreceive a settlement from the state.\n(6) Each organizational unit and administra tive body in the executive branch of state\ngovernment, as defined in KRS 12.010, the Court of Justice in the judicial branch of\nstate government, and, where feasible, any local government shall provide\ninformation to the State Treasurer concerning any debt  it has referred to the\nDepartment of Revenue for collection under KRS 45.241.\n(7) Each agency, the Court of Justice, and, where feasible, any local government shall\nprovide information to the State Treasurer concerning any debt referred to the\nDepartment of Revenue for collection under KRS 45.237.","path":["KRS Chapter 44"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=56564","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:49:03Z","sha256":"8f4626d6f52f6a35ede3787f40600693604d1c26d74183b1a23abf2452722dcc","source_id":"us-ky","stale":false,"prev":"us-ky/krs-44.020","next":"us-ky/krs-44.040"},"notice":"GroundRules: Original legal text.
