{"data":{"id":"us-ky/krs-440.270","jurisdiction":"us-ky","citation":"KRS 440.270","heading":"Person charged with crime in other state may be arrested in this state --","body":"Procedure -- Warrant required.\n(1) Whenever any person within this state shall be charged on the oath of any credible\nperson before any judge of this state with the commission o f any crime in any other\nstate and, except in cases arising under KRS 440.210, with having fled from justice,\nor with having been convicted of a crime in that state and having escaped from\nconfinement, or having broken the terms of his bail, probation or p arole, or\nwhenever complaint shall have been made before any judge in this state setting\nforth on the affidavit of any credible person in another state that a crime has been\ncommitted in such other state and that the accused has been charged in such state\nwith the commission of the crime, and, except in cases arising under KRS 440.210,\nhas fled from justice, or with having been convicted of a crime in that state and\nhaving escaped from confinement, or having broken the terms of his bail, probation\nor parole and is believed to be in this state, the judge shall issue a warrant directed\nto any peace officer commanding him to apprehend the person named therein,\nwherever he may be found in this state, and to bring him before the Circuit or\nDistrict Judge of the c ounty in which he was arrested who may be available in or\nconvenient of access to the place where the arrest may be made, to answer the\ncharge or complaint and affidavit, and a certified copy of the sworn charge or\ncomplaint and affidavit upon which the wa rrant is issued shall be attached to the\nwarrant.\n(2) No bail bondsman or his agent shall arrest, detain, imprison, or remove from the\nstate any person for having broken the terms of his bail unless a warrant for that\nperson's arrest has been issued as provided for in subsection (1) of this section.\n(3) Any violation of subsection (2) of this section shall be deemed as a Class D felony\nand punishable thereas.","path":["KRS Chapter 440"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=19246","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:59:54Z","sha256":"bc6ce49ad8dc41fa61970a0143ae7605d275b1533a7f279bfb95c7a175f1880c","source_id":"us-ky","stale":false,"prev":"us-ky/krs-440.260","next":"us-ky/krs-440.280"},"notice":"GroundRules: Original legal text.
