{"data":{"id":"us-ky/krs-440.400","jurisdiction":"us-ky","citation":"KRS 440.400","heading":"Waiver of extradition by person arrested in this state -- Procedure --","body":"Effect.\n(1) Any person arrested in this state charged with having committed any crime in\nanother state or alleged to have escaped from confinement, or broken the terms of\nhis bail,  probation or parole may waive the issuance and service of the warrant\nprovided for in KRS 440.220 and 440.230 and all other procedure incidental to\nextradition proceedings, by executing or subscribing in the presence of a judge of\nany District or Circuit Court within this state a writing which states that he consents\nto return to the demanding state; provided, however, that before such waiver shall\nbe executed or subscribed by such person it shall be the duty of such judge to\ninform such person of his righ ts to the issuance and service of a warrant of\nextradition and to obtain a writ of habeas corpus as provided for in KRS 440.250.\n(2) If and when such consent has been duly executed it shall forthwith be forwarded to\nthe office of the Secretary of State of this state and filed therein. The judge shall\ndirect the officer having such person in custody to deliver forthwith such person to\nthe duly accredited agent or agents of the demanding state, and shall deliver or\ncause to be delivered to such agent or agent s a copy of such consent; provided,\nhowever, that nothing in this section shall be deemed to limit the rights of the\naccused person to return voluntarily and without formality to the demanding state,\nnor shall this waiver procedure be deemed to be an exclu sive procedure or to limit\nthe powers, rights or duties of the officers of the demanding state or of this state.","path":["KRS Chapter 440"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=19260","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:59:54Z","sha256":"a51e45b4dbe8c0ac6b15b54e6979cb203d04c6dfbdcb821f2f4cce627e66acb6","source_id":"us-ky","stale":false,"prev":"us-ky/krs-440.390","next":"us-ky/krs-440.410"},"notice":"GroundRules: Original legal text.
