{"data":{"id":"us-ky/krs-441.005","jurisdiction":"us-ky","citation":"KRS 441.005","heading":"Definitions for chapter.","body":"As used in this chapter, unless the context otherwise requires:\n(1) \"Jail\" means county jails and correctional or detention facilities, including\ncorrectional facilities defined in KRS 67B.020 and juvenile detention facilities,\noperated by and under the supervision of any political subdivision;\n(2) \"Holdover\" means any jail housing prisoners for a maximum period of ninety -six\n(96) continuous hours and excluding times when a prisoner is released for a\nminimum of seven (7) hours for the purpose of working at his or her employment,\nattending an educational institution, or conducting other business pursuant to a\ncourt order, or when a prisoner is released for in court proceedings;\n(3) \"Prisoner\" means any person confined in jail pursuant to any code, ordinance, law,\nor statute of any unit of government and who is:\n(a) Charged with or convicted of an offense; or\n(b) Held for extradition or as a material witness; or\n(c) Confined for any other reason;\n(4) \"Unit of government\" means that unit of government including the United States\ngovernment whose law, statute, ordinance, or code a prisoner is charged with\nviolating. If a person is imprisoned for contempt of court, the state shall be deemed\nthe responsible unit of government;\n(5) \"Department\" means the Department of Corrections;\n(6) \"Jail personnel\" means deputy jailers, matrons, cooks, and other food service\npersonnel, and other jail employees involved in the supervision, custody, care, or\ntreatment of prisoners in jails but does not include maintenance or clerical\npersonnel;\n(7) \"Regional jail\" means a jail which is:\n(a) Owned and operated by one (1) county and, on a regular basis, holds prisoners\nfor another county or for the state; or\n(b) Owned and operated by two (2) or more counties through a regional jail\nauthority as provided in KRS 441.800;\n(8) \"Commissioner\" means the commissioner of the Department of Corrections; and\n(9) \"Reentry center\" means a supervised community residential facility operated by a\nlocal correctional facility, county jail, or regional jail as detailed in KRS 441.146.","path":["KRS Chapter 441"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=49962","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:59:54Z","sha256":"18e5a2ae96041a27017a0c94587f850fc45c5a2f5ec99edaf80920b520a09853","source_id":"us-ky","stale":false,"prev":"us-ky/krs-4403a.104","next":"us-ky/krs-441.006"},"notice":"GroundRules: Original legal text.
