{"data":{"id":"us-ky/krs-441.046","jurisdiction":"us-ky","citation":"KRS 441.046","heading":"Persons in adult or juvenile detention facility to be fingerprinted -- Failure","body":"of jailer to comply.\n(1) All persons arrested or detained in any adult or juvenile detention facility shall be\nfingerprinted prior to the person's release from custody. A copy of these fingerprints\nshall be transmitted to the Department of Kentucky State Police for review.\n(2) The jailer shall fingerprint persons for other law enforcement agencies.\n(3) The jailer shall submit the fingerprints to the Department of Kentucky St ate Police\nin the manner and at the time required by the Department of Kentucky State Police\nthrough administrative regulation.\n(4) The Department of Kentucky State Police shall notify the Department of\nCorrections and the jailer, in writing, of the intent ional failure of a jailer to comply\nwith subsection (1), (2), or (3) of this section. Upon the first receipt of the\nnotification of an intentional failure to comply with subsection (1), (2), or (3) of this\nsection, the Department of Corrections shall issue  a formal written warning to the\njailer setting forth the consequences of continued intentional failure to comply with\nsubsection (1), (2), or (3) of this section.\n(5) If the jailer intentionally failed to comply with any fingerprinting requirements of\nsubsection (1), (2), or (3) of this section, after being warned of such intentional\nfailure, the Department of Corrections shall have authority to withhold the state\ncontribution under KRS 441.206 and may require the jailer to return the state\ncontribution funds received under KRS 441.206 for any period in which he or she\nintentionally failed to comply after being warned.","path":["KRS Chapter 441"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=19291","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:59:55Z","sha256":"89c94635b8261ea5fc4a132a2563968191476d3fea2af85dd82e1945a1f8f76d","source_id":"us-ky","stale":false,"prev":"us-ky/krs-441.045","next":"us-ky/krs-441.047"},"notice":"GroundRules: Original legal text.
