{"data":{"id":"us-ky/krs-441.047","jurisdiction":"us-ky","citation":"KRS 441.047","heading":"Psychiatric and similar services for criminal defendants.","body":"(1) Whenever a prisoner confined in the county jail is in need of psychiatric or similar\nevaluation, treatment, or services, it shall be the responsibility of the\nCommonwealth to provide such evaluation, treatment, or services at the expense of\nthe Commonwealth at the nearest state -operated or state-supported facility suitable\nfor the provision of the required evaluation, treatment, or services at no cost to the\ncounty.\n(2) Whenever a criminal defendant is in need of psychiatric, sociological, or similar\nevaluation in connection with the criminal proceedings in which he is a defendant it\nshall be the responsibility of the Commonwealth to provide the evaluation at the\nnearest state -operated or state -supported facility suitable for the provision of the\nrequired evaluation at no cost to the county.\n(3) In the event that no suitable state -operated or state -supported facility is located\nwithin a reasonable distance, then the evaluation may be made at a suitable local\nfacility or at the jail. In such instances a reques t must first be made to the Cabinet\nfor Health and Family Services to provide the evaluation, treatment, or service\nunless the situation is an emergency requiring immediate attention. If the cabinet\ncannot provide the service or if the situation is an emer gency, then local resources\nmay be utilized.\n(4) In the event that local resources are utilized in an emergency situation, or when the\nCabinet for Health and Family Services is unable to provide the evaluation,\ntreatment, or service, then the reasonable co st of providing such service, treatment,\nor evaluation shall be paid from the State Treasury in the same manner as other\nmedical expenses of indigent prisoners confined in the county jail.\n(5) The Cabinet for Health and Family Services shall administer the  provisions of this\nsection and shall issue such administrative regulations as necessary to carry out the\nprovisions of this section.","path":["KRS Chapter 441"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=19292","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:59:55Z","sha256":"8f378a7c0d129152cc6ea2bbf1fd2a97d27d5eadb29c1ee0120af063e3e7618b","source_id":"us-ky","stale":false,"prev":"us-ky/krs-441.046","next":"us-ky/krs-441.048"},"notice":"GroundRules: Original legal text.
