{"data":{"id":"us-ky/krs-441.052","jurisdiction":"us-ky","citation":"KRS 441.052","heading":"Insurance coverage of prisoner -- Subrogation of rights to Department of","body":"Corrections' contractee for medical and pharmaceutical services.\n(1) When a unit of local government or regional jail authority facilitates medical care\nfor a prisoner confined i n the jail, holdover, or regional jail who has not been\nconvicted as a felon and who holds a policy, contract, or certificate of insurance\ncoverage in any form, the insurer shall be primary for payment of medically\nnecessary health care benefit claims provided the following conditions are met:\n(a) The reimbursement shall be for medical, dental, or psychological claims that\nare covered benefits under the terms and conditions of the health benefit plan\nheld by the prisoner;\n(b) The reimbursement shall be appl ied under the terms and conditions of the\nhealth benefit plan and in the same manner as though the insured were not a\nprisoner; and\n(c) All premiums for the health benefit plan are current.\n(2) If the unit of local government, combination of units of local  government, or\nregional jail authority has contracted with the Department of Corrections under the\nDepartment of Corrections' contract for medical, dental, or psychological care\naccess, or drugs, medicines, or pharmaceutical services, then the rights of t he local\ngovernment, combination of local governments, or regional jail authority shall be\nsubrogated to the contract provider of such services to the Department of\nCorrections.\n(3) If the unit of local government, combination of units of local government,  or\nregional jail authority has, with the approval of the Department of Corrections,\ncontracted with another pharmaceutical services provider, then the rights of the\nlocal government, combination of local governments, or regional jail authority shall\nbe subrogated to the contract provider of medical, dental, or psychological care to\nthe local jail for access to drugs, medicines, or pharmaceutical services to the unit of\nlocal government, combination of units of local government, or regional jail\nauthority.\n(4) If a prisoner has been transferred from a local jail, regional jail, or holdover to the\nDepartment of Corrections for medical care pursuant to KRS 441.560, then the\ncontract provider of drugs and pharmaceutical services or the contract provider of\nmedical, dental, or psychological care shall be subrogated to the provider of such\nservices to the Department of Corrections.","path":["KRS Chapter 441"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=19295","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:59:55Z","sha256":"1706865824827c5eb0160058f36806db49203613d80c894d1bf1564b3991aa42","source_id":"us-ky","stale":false,"prev":"us-ky/krs-441.050","next":"us-ky/krs-441.053"},"notice":"GroundRules: Original legal text.
