{"data":{"id":"us-ky/krs-441.055","jurisdiction":"us-ky","citation":"KRS 441.055","heading":"Regulation of jails -- Adoption and revision of standards -- Classification","body":"of jails.\n(1) The Department of Corrections shall for those counties which elect to house state\nprisoners in their jail:\n(a) 1. Adopt the recommendations of the Jail Standards Commission created\npursuant to Executive Order Number 81 -1026 and promulgate\nregulations pursuant to KRS Chapter 13A establishing minimum\nstandards for jails. These standards shall include but not be limited to\nrules governing the following areas:\na. Health and safety conditions;\nb. Fire safety;\nc. Jail operations, recordkeeping, and administration;\nd. Curriculum of basic and continuing annual training for jailers and\njail personnel;\ne. Custody, care, and treatment of prisoners;\nf. Medical care; and\ng. Jail equipment, renovation, and construction.\n2. These minimum standards shall specifically allow for:\na. i. Provision of required documents to prisoners through\nelectronic format;\nii. Confidential prisoner access to attorneys through\nunmonitored phone lines in non-contact visitation areas;\niii. Measures to prevent receipt of prisoner mail containing\nintoxicants, including in fabricated legal mail; and\niv. Delivery of mail received from the court, an attorney of\nrecord, or a public official to the prisoner via an electronic\ncopy provided on a secure, personal account after opened\nand inspected in the presence of the prisoner; and\nb. The appointment or employment of persons who have attained the\nage of eighteen (18) years or older who are otherwise qualified to\nserve in the position in which they are appointed or employed to\nwork inside the secure perimeter of the j ail; however, no person\nunder the age of twenty -one (21) years shall be employed as a\ndeputy jailer, possess or exercise peace officer powers, or function\nin a role similar to that of a deputy jailer, nor shall an individual\nunder the age of twenty -one (21) years be employed in a position\nthat involves supervision over inmates or persons yet to be booked\ninto the jail. Persons who are under the age of twenty -one (21)\nyears shall have a high school diploma or a High School\nEquivalency Diploma;\n(b) Develop a jail standards review process, which shall include the participation\nof persons knowledgeable of jail operations to review and amend the\nstandards as necessary. The jail standards shall be reviewed no later than\nDecember 31, 1992, and at least every two (2 ) years thereafter. Fifty percent\n(50%) of the participants in the review process shall be appointed from\npersons representing county interests and fifty percent (50%) shall be\nappointed from persons representing state interests; and\n(c) Provide technical assistance and consultation to local governments in order to\nfacilitate compliance with standards.\n(2) The department shall, for those counties that elect not to hold state prisoners in their\njails, adopt the recommendations of the Jail Standards Commissio n and promulgate\nadministrative regulations pursuant to KRS Chapter 13A to establish minimum\nstandards for those jails. These standards shall be limited to health and life safety\nand shall permit persons who have attained the age of eighteen (18) years or older\nwho are otherwise qualified to serve in the position in which they are appointed or\nemployed to work inside the secure perimeter of the jail; however, no person under\nthe age of twenty -one (21) years shall be employed as a deputy jailer, possess or\nexercise peace officer powers, or function in a role equal to that of a deputy jailer,\nnor shall an individual under the age of twenty -one (21) years be employed in a\nposition that involves supervision over inmates or persons yet to be booked into the\njail. Persons who are under the age of twenty -one (21) years shall have a high\nschool diploma or a High School Equivalency Diploma.\n(3) All minimum standards promulgated by the department applying to jails shall\ninclude requirements for adequate nutrition for p regnant prisoners, an adequate\nnumber of hygiene products for female prisoners, and an appropriate number of\nundergarments for female prisoners.\n(4) The department may establish classifications of jails based on the maximum\npermissible period of incarcerat ion or other criteria and promulgate standards for\neach class of jail.","path":["KRS Chapter 441"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=53747","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:59:55Z","sha256":"fc9b2903ed3d7830750569832509ceb1f48cb15a59e3efa97f769b020bf8b0d4","source_id":"us-ky","stale":false,"prev":"us-ky/krs-441.053","next":"us-ky/krs-441.057"},"notice":"GroundRules: Original legal text.
