{"data":{"id":"us-ky/krs-441.125","jurisdiction":"us-ky","citation":"KRS 441.125","heading":"Working of prisoners at community -service-related projects -- Written","body":"policy -- Prisoner's status not employment.\n(1) (a) As used in this section, \"community -service-related project\" means a project\ninvolving work for:\n1. The Commonwealth or an agency of the Commonwealth;\n2. A county, urban -county, charter county, city, special district, or an\nagency of any of these entities; or\n3. A nonprofit, charitable, or service organization in projects that serve a\npublic purpose.\n(b) Work on a community -service-related project shall not confer private benefit\non a person except as may be incidental to the public benefit.\n(2) Each jailer shall write a policy governing prisoners working on community -service-\nrelated projects, which shall be submitted to the f iscal court for approval. The\nwritten policy shall state at a minimum:\n(a) Which type of prisoner, if any, shall be assigned to which type of work, taking\ninto account the physical and mental abilities of prisoners and security of the\njail and the general public;\n(b) That no prisoner shall be assigned to unduly hazardous work that would\nendanger the life or health of the prisoner or others; and\n(c) That any prisoner may, for a valid medical reason, decline to work on\ncommunity-service-related projects. No p risoner shall be punished or\notherwise penalized for this refusal.\n(3) A prisoner shall not begin work on a particular community -service-related project\nwithout the approval of the director of the relevant entity referred to in subsection\n(1)(a) of this section, or the director's designee.\n(4) Participation in community -service-related projects shall not be deemed\nemployment for any purpose, and a prisoner shall not be deemed an employee or\nagent of the entity for which he or she performs the community service work.","path":["KRS Chapter 441"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=47793","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:59:55Z","sha256":"35a97568a95d674b7ed5f3a5e2433f5f6a4f86f39f6bf1dba20b98e73a56f902","source_id":"us-ky","stale":false,"prev":"us-ky/krs-441.120","next":"us-ky/krs-441.127"},"notice":"GroundRules: Original legal text.
