{"data":{"id":"us-ky/krs-441.135","jurisdiction":"us-ky","citation":"KRS 441.135","heading":"Canteen for prisoners -- Use of profits -- Books of accounts -- Allowable","body":"expenditures -- Jail canteen account balance -- Calculation.\n(1) The jailer may maintain a canteen for the benefit of prisoners lodged in the jail and\nmay assign such jai l employees and prisoners to operate the canteen as are\nnecessary for efficient operation.\n(2) All profits from the canteen shall be used:\n(a) For the benefit and to enhance the well-being of the prisoners; or\n(b) To enhance safety and security within the jail.\nThe jailer shall keep books of accounts of all receipts and disbursements from the\ncanteen and shall annually report to the county treasurer on the canteen account.\n(3) Allowable expenditures from a canteen account shall include but not be limited t o\nrecreational, vocational, and medical purposes.\n(4) Except in counties containing an urban -county government or a consolidated local\ngovernment, in order to ensure adequate, ongoing funding of jail canteen accounts,\nbeginning July 1, 2007, and on the fir st day of each fiscal year thereafter, the jail\ncanteen account balance shall at least equal the following amounts based on the\naverage daily inmate population of the jail:\n(a) 300 prisoners or more ...............................................................................$6,000\n(b) 200 to 299 prisoners..................................................................................$4,000\n(c) 100 to 199 prisoners..................................................................................$2,000\n(d) 99 or fewer prisoners.................................................................................$1,000\n(5) For purposes of calculating the amount to be transferred to the jail canteen account,\nthe average daily number  of inmates shall be equal to the average daily inmate\npopulation of the jail in the immediately preceding fiscal year.\n(6) Notwithstanding KRS 67.0802(6)(a), compensation resulting from the disposal of\nreal or personal property that was purchased from a c anteen account shall be\nreturned to the canteen account from which the real or personal property was\noriginally purchased.
