{"data":{"id":"us-ky/krs-441.450","jurisdiction":"us-ky","citation":"KRS 441.450","heading":"Approval required for remodeling or reconstruction of existing facilities --","body":"When approval not required.\n(1) Any political subdivision, combination of subdivisions, or regional jail authority\ndesiring to remodel or reconstruct an existing local corr ectional facility wherein the\nconstruction will involve physical change of the structure shall obtain the approvals\nrequired by KRS 441.420 to 441.440 and shall reconstruct or modify the local\ncorrectional facility in accordance with the approval.\n(2) Except as provided in subsection (3) of this section, existing local correctional\nfacilities may be renovated without the approval of the construction authority.\n(3) (a) If the renovation includes an increase in the square footage of an existing local\ncorrectional facility to add prisoner bed space, that renovation shall be deemed\nan expansion and shall require the approval of the construction authority as\nprovided in KRS 441.420 to 441.450.\n(b) If the renovation includes an increase in the square footage of an existing local\ncorrectional facility, the authority shall not approve the application unless the\nresulting renovation of the local correctional facility results in a facility with a\nbed capacity of one hundred fifty (150) inmate beds or more.","path":["KRS Chapter 441"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=40920","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:59:55Z","sha256":"c51a28b768a6cf9f99337d2935716d82528df66384f91c43a09e68f87d5d6623","source_id":"us-ky","stale":false,"prev":"us-ky/krs-441.440","next":"us-ky/krs-441.500"},"notice":"GroundRules: Original legal text.
