{"data":{"id":"us-ky/krs-441.510","jurisdiction":"us-ky","citation":"KRS 441.510","heading":"Transporting to and from detention facility.","body":"(1) If an inmate is confined in a detention facility, he shall be transported as necessary\nin accordance with the following provisions:\n(a) If he is lodged in an urban-county facility in the county where the trial is to be\nheld, the jailer shall carry out this duty; and\n(b) In all other cases, the sheriff of the county where the prisoner is incarcerated\nshall carry out this duty as provided in subsection (3) of this section.\n(2) The transportation of any inmate housed in a county detention center whose court\nappearance is necessary in any other county shall be transported by the sheriff of the\ncounty where the trial or court proceedings are to be held.\n(3) If an accused is sentenced to confinement, the sheriff shall deliver him to the proper\ndetention facility, with the exception that in the case of a sentence to an urban -\ncounty detention facility, the jailer shall carry out this duty.\n(4) In each county where there is no jail, the fiscal court or the legislative body of a\ncharter county government, as appropriat e, shall adopt a transportation plan which\nestablishes the party responsible for transporting prisoners as necessary:\n(a) The fiscal court or the legislative body of a charter county government, as\nappropriate, may require the jailer to serve as transporta tion officer to be\nresponsible for transporting prisoners as necessary; or\n(b) The fiscal court or the legislative body of a charter county government, as\nappropriate, may require the sheriff to serve as transportation officer to be\nresponsible for transporting prisoners as necessary; or\n(c) The fiscal court or the legislative body of a charter county government, as\nappropriate, may adopt any reasonable transportation plan so long as the party\nresponsible for transporting prisoners is specified.\n(5) Upon th e recommendation of the jailer, the fiscal court shall employ a female\ntransportation officer for purposes of assisting the jailer during the transportation of\nfemale prisoners, when deemed necessary by the jailer.\n(6) In any county where there is no jail and the jailer does not transport prisoners, the\njailer shall serve as a bailiff to the Circuit and District Courts of the county as\nprovided for in KRS 71.050.\n(7) Nothing in this section shall prohibit the jailer from transporting the prisoners as he\nor she deems necessary.","path":["KRS Chapter 441"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=19356","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:59:55Z","sha256":"7f6be7af6705486bce770f6671e9bba82dab4cc0b0168a0e93ce58dbddcb5114","source_id":"us-ky","stale":false,"prev":"us-ky/krs-441.505","next":"us-ky/krs-441.520"},"notice":"GroundRules: Original legal text.
