{"data":{"id":"us-ky/krs-441.615","jurisdiction":"us-ky","citation":"KRS 441.615","heading":"Kentucky Local Correctional Facilities Construction Authority --","body":"Membership -- Corporate character -- Officers -- Staff -- Records.\n(1) There is created and established within the Finance and Administration Cabinet a\nKentucky Local Correctional F acilities Construction Authority, composed of ten\n(10) members who shall be:\n(a) The secretary of the Finance and Administration Cabinet, or his designee;\n(b) The commissioner of the Department of Corrections, or his designee;\n(c) The designee of the Kentucky Jailers Association;\n(d) The designee of the Kentucky County Judges/Executive Association;\n(e) The designee of the Kentucky Association of Counties;\n(f) The designee of the Kentucky Magistrates and Commissioners Association;\n(g) Two (2) citizen members appointed by the Governor; and\n(h) Two (2) members of the General Assembly appointed by the Governor.\n(2) The ex officio members shall serve for the term of their respective office. The\nlegislative members of the authority shall serve at the pleasure of the Governor.\n(3) Citizen members shall begin their terms on August 1, 1982, and shall be appointed\nfor a term of four (4) years; however, in making initial appointments, the Governor\nshall appoint one (1) member for a term of two (2) years, and one (1) member for a\nterm of three (3) years.\n(4) Vacancies occurring in the term of any member shall be filled in the same manner\nas the original appointment.\n(5) The ten (10) members of this authority and their successors are a body corporate\nand politic constituting a public corpo ration and governmental agency and\ninstrumentality of the Commonwealth, with perpetual succession and with power in\nthat name to contract and be contracted with, to acquire and convey property, to sue\nand be sued, to have and use a corporate seal, and to e xercise all of the usual\npowers of corporations not inconsistent with specifically enumerated powers.\n(6) The members of the authority shall receive no compensation for their services, but\nshall be entitled to reimbursement for all reasonable expenses nece ssary and\nincidental to the performance of their duties and function as members of this\nauthority.\n(7) The chairman of the authority shall be the secretary of finance. The members of the\nauthority shall elect a vice chairman and secretary from their membership.\n(8) The secretary of the Finance and Administration Cabinet shall designate an\nemployee of his cabinet to serve as treasurer of the authority. The treasurer shall\ngive bond to the authority for a faithful accounting for all funds coming into his\ncustody, in the amount the authority may prescribe, drawn upon a surety company\nqualified to do business in the Commonwealth, the premium to be paid by the\nCommonwealth.\n(9) The authority shall establish and maintain an office and the secretary of the\nauthority shall maintain there complete records of the authority's actions and\nproceedings, as public records open to inspection. The Finance and Administration\nCabinet shall provide the funds, staff assistants, facilities, and materials required by\nthe authority in the conduct of its duties and functions. The secretary of the Finance\nand Administration Cabinet may require the Department of Corrections to share in\nthe expenses incurred by the Finance and Administration Cabinet in maintaining\nand operating offices of the authority.","path":["KRS Chapter 441"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=19364","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:59:55Z","sha256":"a5e8c47d550f9db35fbbc08d8540317e17cbd628c2dbbe8d3a0d1848394825fc","source_id":"us-ky","stale":false,"prev":"us-ky/krs-441.610","next":"us-ky/krs-441.620"},"notice":"GroundRules: Original legal text.
