{"data":{"id":"us-ky/krs-446.013","jurisdiction":"us-ky","citation":"KRS 446.013","heading":"Terms \"mental retardation\" and \"mentally retarded\" not to be used in","body":"statutes -- Acceptable replacement terms.\n(1) Except as provided in this section, the Kentucky Revised Statutes shall no longer\nutilize the terms \"mental retardation\" or \"mentally retarded\" or abbreviations that\nuse the letters \"MR\" to signify mental retardation or mentally retarded.\n(2) The terms \"retarded\" or \"retardation\" shall not be utilized in the Kentucky Revised\nStatutes to refer to an intellectual disability.\n(3) Except as provided in subsections (4), (5), and (6) of this section, the terms \"mental\nretardation\" or \"mentally retarded\" shall be replaced in the Kentucky Revised\nStatutes, as appropriate, by the terms:\n(a) \"Intellectual disability\";\n(b) \"Intellectual disabilities\";\n(c) \"Individual with an intellectual disability\";\n(d) \"Individuals with an intellectual disability\";\n(e) \"Individual with a serious intellectual disability\"; or\n(f) \"Individuals with a serious intellectual disability.\"\nThese terms, when substituted for  \"mental retardation,\" \"mentally retarded,\" or\n\"MR\" shall be understood to have the exact meaning as the terms that they replace.\n(4) The names of state and local governmental agencies shall no longer contain the\nterms \"mental retardation,\" \"mentally retar ded,\" \"retardation,\" \"retarded,\" or\nabbreviations that use the letters \"MR\" to signify mental retardation or mentally\nretarded, and shall be changed to describe the function of that agency without use of\nthese terms.\n(5) A nongovernmental entity named or s eeking to be named in the Kentucky Revised\nStatutes that utilizes \"mental retardation,\" \"mentally retarded,\" \"retarded,\"\n\"retardation,\" or the letters \"MR\" to signify mental retardation or mentally retarded\nin the name it seeks to include in statute, shall  be encouraged to modify its name so\nthat these terms are not utilized in statute.\n(6) To the extent permitted by federal law, ICF/MRs shall now be referred to as\nICF/IDs.","path":["KRS Chapter 446"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=40740","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:48:20Z","sha256":"a11841b7a431d42ef1789536fac8dc98d0ed489337fef2c5e48c1f24b009b0e3","source_id":"us-ky","stale":false,"prev":"us-ky/krs-446.012","next":"us-ky/krs-446.015"},"notice":"GroundRules: Original legal text.
